Judge: Dade Holding Arrested Immigrants For ICE Is Unconstitutional

MIAMI (CBSMiami) — A Miami-Dade judge ruled Friday that county holds of arrested immigrants for ICE is unconstitutional but debate is not over.

While the judge ruled against the county, the practical effect of the ruling on arrested immigrations is not yet clear since the county can appeal the decision.

Just a day before, attorneys for a detained immigrant and Miami-Dade squared off in court over Mayor Carlos Gimenez’s and the county commission’s decision to honor ICE requests to hold arrested immigrants beyond the time they would otherwise be released.

“Please, hold this individual on our behalf, pursuant to our authority to detain him, for 48 hours so we can coordinate our agents to go pick that individual up,” said County Attorney Michael Valdes in explaining the ICE requests.

As for the Haitian immigrant James LaCroix, ICE picked him up from the county jail for deportation Wednesday, where he was being held after completing his sentence of 7 days for time served.

But this case isn’t about deportation. It’s about the detention policy, one in which the judge upended on Friday.

Geez.  Would the county hold someone for another law enforcement agency than ICE if there were outstanding warrants for him in other jurisdictions?  If so, then this is just an example of another judge making up law as he goes.  And the action is most definitely not unconstitutional.

Simple. Trump authorizes an ICE office in each city and town in America with an agent stationed in every PD/lockup, then builds and staffs offices fully under emergency measures. Congress reallocates all funding from the judiciary to reimburse and fund future operations.

No net increase in spending, 100% constitutional and the black robed government is forever gutted.

Simple. Trump authorizes an ICE office in each city and town in America with an agent stationed in every PD/lockup, then builds and staffs offices fully under emergency measures. Congress reallocates all funding from the judiciary to reimburse and fund future operations.

Good. But you would not even need a separate ICE office. Would require state and local buy in, but simply assign ICE personnel to every precint. They have one task. Identify the perps and have a judge lined up to issue whatever paper is required to habeas corpus their asses to the proper authority. Removes the excuse that they lack the time or resources to sort these peoples out.

Gee, Norm, I was gonna post pretty much what you did, but you beat me to it!

Have ICE agents ready-and-waiting, no "holding" will be necessary!
