My initial reaction is good. The issue has no business in the courts and each addition step through the judicial system validates the courts as a legitimate authority.

Fresh from a legal setback to his travel ban, U.S. President Donald Trump is considering signing a new executive order on immigration and is not planning to escalate the dispute over an earlier travel ban to the U.S. Supreme Court, according to media reports late on Friday.

Trump's executive order banning entry to the United States by refugees and citizens of seven Muslim-majority countries was put on hold by a federal judge in Seattle last week, and that suspension was upheld by an appeals court in San Francisco on Thursday.

MSNBC reported on Friday that a senior official said the Trump administration will not ask the U.S. Supreme Court to reconsider the ruling by the federal appeals court. The administration could still ask a larger panel of judges of the appeals court to reconsider the case.

The Associated Press reported that Trump said he is considering signing a new executive order.

The White House is not ruling out the possibility of rewriting Trump's Jan. 27 order in light of the court actions, an administration official said.

Trump's order, which he has called a national security measure to head off attacks by Islamist militants, barred people from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entering for 90 days and all refugees for 120 days, except refugees from Syria, who are banned indefinitely.

Wait till the ninth seat is filled before bringing the matter to the SCOTUS.

With any luck one or two of the other leftist fossils will kick off in the interim and the constitutionalist faction will be even stronger.

During a press conference Friday with the prime minister of Japan, Trump suggested that the White House is trying to redraft the order to strengthen it against legal challenges, which he expects the administration to continue to fight in court.

“We’ll be doing something very rapidly having to do with additional security for our country,” Trump said, without offering details. “You'll be seeing that sometime in the next week. In addition, we will continue to go through the court process and, ultimately, I have no doubt that we’ll win that particular case.”

There have also been rumblings that the Trump administration will do both ... battle in court and issue new EOs to protect the nation.   :shrug:

Going through the courts also keeps the floodgates open with our fifth column pushing Syrian "refugees" through the door--and the SC will stay 4-4 for a while---so they're worse than useless.

There are currently 18 US Court of Appeals vacancies and 91 US District Court vacancies.  ( http://www.uscourts.gov/judges-judgeships/judicial-vacancies )  The Trump administration needs to fill those and Congress needs to get busy splitting the 9th Circuit Court so Trump can nominate judges for the vacancies this would create.

You can thank Trump and Bannon for this debacle.  A poorly constructed EO, thrown in prematurely, before getting a friendly solicitor and court, followed by idiotic tweeting.  Bannon's getting his chaos alright!  He wanted America in disarray and disrupted. Well, he got his wish.

He probably knows that with one Conservative down currently at SCOTUS, and if they fast track it to where it will be heard before it is filled, the chance is greater it is struck down. If it is struck down at SCOTUS, that pretty much kills it.

I have seen no indication that the administration is just going to drop the matter.  I think the idea is to slow walk this through the courts while fast walking getting their nominee on SCOTUS.

I know Congressman Gohmert advised him to issue a new EO without the green card/visa provision in it. That may be what's coming.
