"I wish it need not have happened in my time," said Frodo.

"So do I," said Gandalf, "and so do all who live to see such times. But that is not for them to decide. All we have to decide is what to do with the time that is given us."

No, they won't get it until G is seated.

It depends on when the appeal is filed and then the court makes the decision on when to hear the case. Gorsuch does not need to wait to be seated for them to go into session. The first session begins February 21st, so the filing for this will have to happen fast and then Gorsuch's confirmation will need to take place w/ in the next week too.

I'm sure with this potentially hitting, the Dems will go for every stall tactic they can.

I wonder who the President will tap to argue the administration's case before SCOTUS?

Yes.   Cut them off at the knees before they can get any encouragement.

Revoke all Visas from the affected Countries.  Refuse to issue any more.  Tell the Idiot liar Judge in Washington to go F*** himself,  and tell the 9ths Circuit that Donald Trump runs Barter Town.

Don't these decisions basically subordinate the State Dept to the plaintiff states? Doesn't seem legal.

Trump just should go ahead with it anyway.

I wonder what the legal liability risk is for individual people to act on this. For example, if a Custom's agent follows the guidline of the 9th Circuit and not the administration, could he face personal sanctions by the administration. And vice versa.

At this point, it won't be Trump going ahead with it, it will be the individual departments in charge of enacting the EO making this decision. Trump already made his EO, the latest court made their ruling, the departments have to decide which way to go. This isn't something they can just 'wait and see'.

9th Circuit spends 3 days looking for copy of Constitution, can't find one anywhere in CA, and rules on immigration anyway.

I don't understand how they can rule the way they do when the constitution and law are so clear on this matter   Then again they are the 9 th circus.  It shows how leftist our country has become  I'm  not sure there is any turning back at this point

As I  posted upthread, this opinion contains no reference to either the law or fact.  Just a bunch of emotional BS.

It need not be that complicated.   Just revoke all Visas from the nations in question,  and order State not to issue any more.

The rules at the port of entry are "No Visa,  no stay."

All orders are carried out in the foreign nations where none of these courts have any jurisdiction.

Same result,  and the courts can't do anything but roll around on the floor in a temper tantrum.

This is why he should declare it an official national security issue, get a FISA ruling and arrest anyone interfering under sedition regs.

First, it actually IS a matter of national security
Second, the Constitution grants him the clear authority

The Congress should immeadiately drop everything and get to work dismantling the current liberal controlled federal courts and reestablishing them as fair arbiters of the law. AKA Fire the most leftist of the judges/those with records of judicial advocacy.

This too is 100% within the constitutional authority of congress and the exec.

Stop F'ing around with this mess and govern like a constitutional majority.

This country is willfully self-destructive.

The Tweet from Trump indicates that Jeff Sessions, the new Atty. General is going to bring this case to the Supreme Court.

I'm afraid it will be either a 4-4 or 5-3 decision ( Justice Kennedy might side with the left side of the court ).
