Judge: Put Hillary's top aides under oath
'This case is about the public's right to know'

A federal judge is tired of the “drip, drip, drip of declarations” related to the investigation into Hillary Clinton’s private email server and says it is time for her top aides to be questioned under oath.

U.S. District Judge Emmet G. Sullivan’s decision on Tuesday was hailed as a “major victory” by Judicial Watch, one of dozens of organizations with active FOIA lawsuits related to Clinton’s “home brew” email server she used as U.S. secretary of state from 2009 to 2013.

“There has been a constant drip, drip, drip of declarations. When does it stop?” Sullivan said, the Washington Post reported. “This case is about the public’s right to know.”

Sullivan said there was “reasonable suspicion” to conclude that public access to official records related to the Democrat front-runner was undermined.

Judicial Watch is keen to question Clinton aides Cheryl D. Mills, Huma Abedin, Jacob Sullivan and Philippe Reines. Others who face inquiries include John F. Hackett, director of information services; Executive Secretary Joseph E. Macmanus; lawyer David E. Kendall; and Bryan Pagliano, a 2008 Clinton staff member who helped set up her server.

“What emails … were deleted … who decided to delete them, and when?” the government watchdog asks in it court filings, the newspaper reported.

Abedin, who was once simultaneously employed by the State Department, the Clinton Foundation, Clinton’s personal office and a consulting firm linked to the Clintons, is also caught in a State Department investigation into the Democrat front-runner’s foundation. State Department investigators subpoenaed the organization, but also included a request for documents relating to Abedin.

An attorney for Abedin declined to comment for the newspaper’s story.

“The court-ordered discovery will help determine why the State Department and Mrs. Clinton, even despite receiving numerous FOIA requests, kept the record system secret for years,” Judicial Watch President Thomas J. Fitton said in a statement released Tuesday. “While Mrs. Clinton’s testimony may not be required initially, it may happen that her testimony is necessary for the Court to resolve the legal issues about her unprecedented email practices.”

Anne L. Weismann, executive director of the Campaign for Accountability, said Sullivan’s decision has opened a Pandora’s Box, the contents of which are likely to be painful for Clinton.

“[This won’t end] until there are endless depositions of top [agency] aides and officials, and just a parade of horribles,” Weismann told the Post.

Nearly 100 FBI special agents are attempting to determine if Clinton violated a subsection of the Espionage Act related to “gross negligence” in handling government documents. That investigation also has a second track, which is to determine whether co-mingling of the Clinton Foundation and State Department business violated public corruption laws.

A Fox News investigation revealed in late January that intelligence known as “special access programs,” or SAP, passed through Clinton’s server. The documents were so sensitive that senior lawmakers with the highest levels of security clearance were required to sign additional nondisclosure agreements before viewing them.
