ALBUQUERQUE (KRQE) – The hearing continues over whether a teen, who murdered his family, should be sentenced as an adult.

Nehemiah Griego, now 18,  shot and killed his mother in the middle of the night as she slept and then murdered his three younger siblings at their South Valley home in 2013. The home-schooled boy then ambushed his father when he later came home.

Bernalillo County deputies didn’t make the disturbing discovery until the evening after the murders.

At first, only one deputy showed up to the home on Saturday, January 19, 2013. Deputy Stephen Cotton testified that the 911 call came in as a call to “make contact” with a teen. He figured he’d just be meeting with a boy who needed to talk or get help with something.

“When this one came in it was weird. It was very vague,” Cotton said.

There was no warning of the gruesome scene he later walked into: Griego’s parents and three younger siblings all shot to death in their home.

Testimony revealed that 911 was called after Nehemiah had asked to spend the night where his 12-year-old girlfriend lived, at her grandmother’s home. When the grandma asked why, she testified that Nehemiah said he had been living alone for a while after his parents died in a car accident.

That set off a red flag for the grandma, who notified members of Nehemiah’s church. They called 911 to have deputies look into what was going on.

When a deputy arrived, Nehemiah made up another story about what had happened.

“His words were that he found his entire family ‘deceased,'” Cotton said.

Griego told Deputy Cotton he’d been sleeping over at a friend’s house.

“I did not have a good feeling when I was speaking with him,” Deputy Cotton said.”I felt like something was seriously wrong.”

Also Tuesday in court, disturbing text messages were described between Griego and his then 12-year-old girlfriend before the murders. A detective said the messages reveal both Nehemiah and his girlfriend had plans to kill their parents, but she backed out.

The detective said Griego tells his girlfriend he’s feeling insane in the messages. The defense asked the detective Tuesday if the girlfriend seemed to be egging Griego on and he said yes.

The detective also said Griego sent a picture of his mother and brother after they were killed to prove he did it. He said the two teens then sent sexual texts to each other.

“I didn’t feel like she emotionally responded to someone who was close to someone who did this,” said the detective on the stand.

Monday, a psychologist said Griego told him he killed his family because his parents were abusive.

Prosecutors want the teen punished as an adult which could mean life in prison.

The defense claims he has mental health issues and was socially isolated and abused by his father. They want him to get treatment and stay in juvenile jail where he could get out when he’s 21.

ALBUQUERQUE, N.M. (AP) - A New Mexico district attorney says she's disappointed a teen who pleaded guilty to killing his parents and three younger siblings will be sentenced as a juvenile, and her office is considering an appeal.

Bernalillo County District Attorney Kari Brandenburg says a final decision on an appeal hadn't been reached Friday, a day after a children's court judge ruled lawyers for 18-year-old Nehemiah Griego had shown he is receptive to psychological treatment.

The judge's decision means Griego will be sentenced as a juvenile and released from state custody by the time he turns 21. He was 15 when his five family members were shot and killed.

Brandenburg says prosecutors in the case were seeking justice for the victims and extensive treatment for Griego.

Griego has been undergoing therapy since May 2014 at a state facility for adolescents.

Just because he may be eligible, does NOT mean he should be released.
