A couple guys did a controlled burn on federal land. They informed the Feds and they were okay with it.

After, the Feds had regret, and charged them. They spent some time in jail and were released.

Then the Feds wanted to send them off for more time (double jeopardy) and things got icky.

A ranger station at a bird sanctuary was taken over by sympathizers and a standoff ensured.

Now, people are getting shot dead.

Just a note: Where in the Hell have the Oregon Governor, Oregon State officials (elected and appointed), Oregon Senators, and Oregon House Reps. been, during this conflict over Oregon vs. The FedGov ??

These types of issues are NOT new. All across the West from the beginning, conflicts over land usage have been present. Water is one issue. Who gets it, how much, who controls it, etc.

Cattle vs. sheep was once a hot topic for conflict. In this case as I understand it, local ranchers once enjoyed routine access to federal lands, but that access has been restricted, withdrawn.

In Nevada Cliven Bundy had lost multiple court cases. Hammonds in Oregon had lost court cases. But a bunch of armed militia, many from out of state, nevertheless came armed to have a showdown.

The guy who got himself killed had come all the way from Arizona, had written a book with a final shootout, was previously interviewed in a blue tent, and  vowed to not leave alive.

Contrast these militia cowboys, with peaceful surfers in California. We have city, county, state, federal and private ownership of beaches and world class surfing locations.

Contesting for use includes wildlife preservation, fishing, water sports, among just a few.

We have not witnessed an out of area surfer, showing up armed and vowing to die, like this Arizona rancher.

He was looking for drama and trouble. The locals in Oregon wanted the outside troublemakers to leave. 

I am the grandson of a Wyoming cowboy. He married a Mormon girl. I believe my people would say the locals have a valid beef over access, for their livelihoods. But they would urge people to stay away, and not stir up violent trouble.

Last night news broke that #OregonStandoff Spokesperson Robert “LaVoy” Finicum was shot and killed during a federal traffic stop near Burns, Oregon. In the hours following the shooting reports started coming out suggesting it may very well be possible Finicum had his hands up and did not present a weapon, nor did he attempt to cause harm to agents.

The reports asserting this included claims there was a witness or witnesses in the vehicle who watched the entire event unfold. But until now we hadn’t heard from those witnesses publicly.

Now one of the witnesses has completed a gut-wrenching interview in which she says FBI agents fired an estimated 120 rounds at Finicum and his vehicle, six of which entered his body.  ...

Moreover, Finicum believed he was combating an overbearing and dictatorial federal government and that is in the finest of American traditions of resisting tyranny, no matter how soft or seemingly benign. You can disagree with his assessment of how our government acts, and with his form of resistance, but to call him a "lousy dad" for standing up for what he believed in is really quite reprehensible.

An eyewitness and his daughter have provided the first outside account of the shootout between members of the Oregon militiamen who had seized the Malheur National Wildlife Refuge complex and a blocking force of FBI agents who kept the vehicle from escaping an attempted traffic stop.

    He said he got out of his pickup and saw “a lot of smoke coming off of the Bundy vehicle and the FBI was hollering at them.”

    He said he saw 3 protesters and as many as 15 people with the FBI and OSP.

    Shots were fired, dogs began barking and “after a very short time they returned fire.”
    Though there was “a lot of shooting going on,” Doherty said he didn’t see anybody get shot.

    “I saw them shooting at each other.”

    The shooting happened in a very short time — “maybe 12 to 15 seconds” — but there were possibly 6 shots. “I really couldn’t tell who was shooting, doing most of the shooting. I did see some shots hit the pickup,” Doherty told KOIN 6 News.

    Three people surrendered, he said, coming out one at a time with their hands up.
This account differs somewhat from both the official FBI version of events and several different accounts provided by Bundy group supporters, none of which match.

A young woman who identified herself as Victoria Sharp claims to have been in the vehicle during the felony stop in which Robert “LaVoy” Finicum was killed and Ryan Bundy was shot, but her story is self-contradictory and claims more than a hundred shots were fired, far more than any other account. Ammond Bundy’s bodyguard Mark McConnell was the driver of the other militia vehicle which was taken into custody without incident. He stated that he spoke with two other people in Finicum’s vehicle who stated that Finicum “charged” the FBI officers. McConnell’s story comes closer to matching what the FBI and now Doherty are relating.

Eyewitness accounts are notoriously inaccurate, and it has been well documented in controlled experiments that people observing the same event from the same perspective can “see” wildly different things based partially on a mish-mash of their prior experience, on what they expect to happen and can comprehend, and what actually happened.

Importantly, the FBI says that they did videotape the stop, and that they shot Finicum as he was reaching for a weapon on his waistband:

I would strongly suggest to the FBI that releasing the long-form video would go a long way to helping the American people understood what occurred in this shooting, and would perhaps stop potential reprisal attacks against federal officials and installations from many militia groups around the nation who are now reported to be on alert after Finicum’s death.

Most of the protesters at the Malheur National Wildlife Refuge have left the headquarters complex overnight at the urging of Ammond Bundy. Less than a dozen protesters are thought to remain.

An eyewitness said that the shooting that took place on Tuesday that resulted in the death of Robert "LaVoy" Finicum all happened as a result of federal agents firing their weapons unlawfully. The woman claims that not one of the people who were stopped drew their gun. All of the bullets fired were from federal agents.

First, take a listen to Mark McConnell, who lists all the people who were in the vehicles when the stop occurred. He makes mention of an unnamed 18-year-old girl, who I'll let you hear later in the article, who claims to have been inside the truck when the shooting occurred.

He claims to have been the first vehicle stopped by several trucks. He was driving Ammon Bundy. However, after they were "secured," McConnell says that the feds that detained them radioed ahead to detain the other vehicle, which LaVoy was driving. He estimated that they were about 200 yards ahead of him, when someone got out of the passenger's side and that person "went to the ground… were handcuffed."

Ryan Payne then drove away, but McConnell says that was not the smartest move. He wasn't saying it to put him down, but just an honest assessment of what takes place when you do that. Why it would be considered an "act of aggression" though seems strange to me.

McConnell says that what took place once they were out of sight is only what he is piecing together from the story of Shauna Cox and Ryan Payne. He does believe Finicum was very passionate about what they were involved in and did comment that Finicum "charged" the feds, but the reality is that he could not see what took place at that time.

However, a young woman by the name of Victoria Sharp called a trusted friend, who recorded the conversation. She told him that she had been in the truck with Finicum. She may just be the woman that McConnell referenced in his video. Take a listen.

"All of them had like a laser on us, it was turn off the car, put your hands out the window," Sharp told the interviewer. "So, he put his hands out the window so they could see he didn't have a gun and he said, 'we're going to talk to the sheriff right now. Either you can put a bullet through my head right now or we're going to talk to the sheriff.'"

Several others arrived with their weapons drawn and the men in the vehicle responded, "We have women in the car."

"Get the women out of the car! Get the women out of the car!" came the call, according to Sharp.

She says Ryan Payne put his hands out of the window and attempted to speak to the agents who pulled them over. However, she also said that as soon as he put his head out of the window, someone took a shot at him, but missed.

"Oh they mean business, they are going to shoot us," she said the Payne said in response.

LaVoy then exited the vehicle, according to Sharp, and LaVoy told the agents, "I'm just going to drive and I'm just gonna talk to the sheriff, or shoot me now or let us go."

"Get out of the car and put your hands up," was the response of the agents.

Payne then drove away. Everyone got in the floorboard, according to Sharp, as the agents unleashed a hailstorm of bullets into the vehicle. Apparently, LaVoy's diesel truck got stuck in a snow bank. This is probably what McConnell references in his video about an attempt to possibly go around a road block that had been set up a mile up the road. More bullets were shot into the vehicle, according to Sharp.

Ryan Bundy was apparently shot in the shoulder sometime in the middle of this.

She then claims that LaVoy exited the vehicle with his hands in the air shouting, " If I can't see the sheriff, just shoot me then."

"They shot him right there… they shot him dead, and after he was down on the ground, they shot him three more times, and then they bombarded our vehicle with bullets."

Sharp claims the agents used gas on the truck several times. The woman claims that the media's report of only three shots being fired is grossly inaccurate and she estimated that there were well over 100 shots fired, all by the agents. She also claims that though they were armed, not one of the passengers of the vehicle went for their weapon.

She also claims there were a lot of vehicles and that numerous lasers were targeted on each of them. It begs the question how any of them survived. Does anyone remember this incident in which 13 police officers shot 137 rounds into a car that left two dead?

"There were people in the trees," she added. "It was an ambush set up, an ambush or something, cause it was snipers and people in the trees… We saw them. They were all pointing their lasers. I had like 20 lasers on me when I was getting out of the car."

All of this occurred as they were on their way to a meeting with a constitutional sheriff to which they had been invited.

I believe we need pictures of the truck to validate the claims of the number of bullets shot. However, when considering who we should trust in all of this, remember that the FBI has not been known to have the best track record when using excessive force. From what we know of the Bundys and others, they have no track record of using force, but responding to it defensively. Exhibit A would be a look back at what took place at Bundy Ranch.

Finally, I'll add this radio show from constitutional attorney, author and educator KrisAnne Hall who aptly points out that we must control that narrative of what took place. This was not a shootout, since only the feds actually shot their guns. This was clearly a setup.

 The FBI has released a video from the Tuesday traffic stop that led to the shooting death of one of the armed protesters who had been occupying the headquarters of a federal wildlife preserve in Oregon.

The video is intended to counteract some of the contradictory accounts of what happened and give an unfiltered view of the incident, which ended with the death of rancher LaVoy Finicum.

Some accounts have argued that Finicum was surrendering to police with his hands up before he was shot, while another stated he was on his knees. Law enforcement has claimed he was refusing to surrender.

The FBI said the video was shot from overhead by a plane following the protesters’ vehicles – a white truck in front, and a jeep in back. Authorities said the operation lasted more than 25 minutes, but the edited eight-minute video shows the most pertinent moments.

An unedited video showcasing the entire event was also released online.

The FBI said viewing the video will be upsetting to some people, but “we feel that it is necessary to show the whole thing unedited in the interest of transparency.”

The footage picks up a few seconds before the FBI and Oregon State Police vehicles pull in behind the jeep, the second vehicle in line. The jeep quickly pulls to a stop while the white truck, driven by LaVoy Finicum, continues some distance up the road. Some law enforcement vehicles stay with the jeep while others continue following the white truck.

Out of view of the camera, the following people exit the jeep without incident: the driver, who was not named or charged; Ammon Bundy, the leader of the group occupying the Malheur National Wildlife Refuge building; and protester Brian Cavalier.

About four minutes into the video, Ryan Payne exits through a back door of the white truck. In the lower right hand corner of the video, he can be seen with his hands up, being approached by law enforcement officers, and being taken into custody, the FBI said.

For over three minutes, the white truck sits on the road. The FBI edited the time in the excerpted version, but said agents and troopers were telling the occupants to surrender.

The white truck is then seen leaving the scene at a high rate of speed. It travels some distance, quickly approaching a law enforcement blockade on the roadway.

“As the white truck approaches the roadblock, there is a spike strip across the road, but it appears Finicum missed it as he attempted to drive around the roadblock,” said the FBI. “He nearly hits an FBI agent as he maneuvers to the left. The truck gets stuck in the snowbank.”

At this point, Finicum is seen leaving the truck and stepping through the snow. Agents and troopers were told that Finicum and others would be armed, the FBI said.

On at least two occasions, Finicum reached toward the inner left pocket of his jacket with his right hand. “Finicum did have a loaded 9 mm semi-automatic handgun in that pocket,” the FBI stated

Then Oregon State Police troopers shot Finicum.

The FBI said approximately 30 seconds after the shooting, law enforcement officers deployed flash bangs to disorient any other armed occupants. They then fired sponge projectiles with OC capsules (similar to pepper spray). Agents and troopers arrested the remaining truck occupants and took them into custody over several minutes. Those arrested included Ryan Bundy, Shawna Cox, and another woman who was not arrested and is not named.

At 5:51 he pulls his truck onto the snowbank to avoid the roadblock

At 5:56 he gets out of his vehicle he puts his arms up, at his sides, 90 degree angle as if his arms are airplane wings

he then puts his arms down several times, and looks like he is reaching into his jacket.

At 6:10 he is shot dead.

FBI Plane Captures Moment Of LaVoy Finicum’s Death

    This is a shortened and edited version of FBI footage showing the joint FBI and Oregon State Police traffic stop and OSP officer-involved shooting of Robert “LaVoy” Finicum on the Malheur National Wildlife Refuge.

You’ll note that Finicum was shot by an Oregon State Police Trooper at relatively close range as he appeared to be reaching into his coat in a manner consistent with attempting to draw a handgun.

Flash bangs were then deployed in an effort to get the other occupants of the vehicle to surrender.

The claims of Victoria sharp that Finicum was shot while surrendering, and that more than 100 shots were fired, is an obvious lie.

Update: Additional commentary via USA Today:

    Bretzing said Finicum eventually pulled the truck over and was ordered by officers to surrender.

    “Finicum leaves the truck and steps through the snow,” Bretzing said. “Agents and troopers on scene had information that Finicum and others would be armed. On at least two occasions, Finicum reaches his right hand toward a pocket on the left inside portion of his jacket. He did have a loaded 9 mm semi-automatic handgun in that pocket. At this time, OSP troopers shot Finicum.”

    FBI agents are not generally equipped with body cameras, but video of the incident involving Finicum was captured by the FBI plane. The footage at times is obscured by trees but at one point, Finicum can be seen reaching toward his jacket pocket.

    The FBI said agents and troopers found three other loaded weapons inside the truck: two .223 caliber semi-automatic rifles and a .38 special revolver.

His hands were up at the 5:57 mark but right before he was shot, he did start dropping his hands and reaching into his coat. (close up images coming in the thread)

This is 6:03 when he drops his hands and puts them in his coat.


Here is 6:05 right before he was shot, hands still in his coat, he turned towards the officer behind him who it appears is the one who shot him (officer on the left).



This contradicts several early stories and reports such as his hands were up the entire time, they were shooting in the car at him, and his back was to the officer who shot him (he kept turning toward the officer behind him and moving away from the other officer when he was moving his hands down into his coat)

If you had your hands up and were shot, were would your hands go?

I don't know but without audio, there is still room for speculation.

Is it possible he was grasping at a gunshot wound?
