Ted Cruz Reverses His Support for Chief Justice Roberts

Republican presidential candidate Ted Cruz said Saturday that Presidents George H.W. Bush and George W. Bush picked Supreme Court Justices David Souter and John Roberts because they weren't strong conservatives.

And, in his remarks to the conservative Eagle Council convention in St. Louis, the Texas senator distanced himself from previous support of Roberts, who is now chief justice.

"Now in both instances, it wasn’t that they were looking for someone who wasn’t a conservative, it’s that it was easier," Cruz said, according to BuzzFeed News. "Neither Souter nor Roberts had said much of anything.

"They didn’t have a paper trail, they wouldn’t have a fight," he said. "Whereas, if you actually nominate a conservative, then you gotta spend some political capital. Then you gotta fight."

Cruz's said that if Souter and Roberts had not been on the court, state marriage laws would not have been circumvented by the Supreme Court's 5-4 gay marriage ruling in June.

Roberts dissented, however. Souter retired in 2009.

The senator's comments also marked a sharp reversal for his support of Roberts in 2005, BuzzFeed reports.

The report cites Cruz's support for Roberts' nomination in a 2005 op-ed piece for the National Review and an internal memo he wrote as Texas Solicitor General praising Roberts' skill as a litigator.

"I’ve worked with John and seen him argue numerous cases, and, to my mind, there’s not another appellate advocate who’s even close," Cruz wrote.

The two-day Eagle Council event, at which six GOP contenders spoke, was sponsored by longtime conservative activist Phyllis Schlafly.

Kennedy was the swing justice on that one, and seeing that he's long been quite libertarian on most issues (and very pro-gay, possibly even closeted seeing that he's unmarried, see also the Lawrence v. Texas ruling) it was never a surprise how he would rule. He's otherwise been a pretty reliable conservative.

No, Roberts's crime is giving Obama a legal cover for Obamacare, declaring a right to coercive taxation, and denying the basic language of what "established by the state" says.

I think it is more aimed at Cruz to focus on his past support of a non-conservative.  Cruz is the most conservative candidate that the GOP has.  He would certainly disrupt the Washington cartel.  He would hit the GOP establishment like a tsunami that they didn't see coming.  Only problem for Cruz is, can he withstand the brutal undercutting and corruption of the GOP establishment or will they destroy him?  So far Trump has kept them busy.

Cruz is absolutely right that Bush Sr. And Jr. Never wanted to fight the Democrats and use capital and muscle to win.  Their view of their political enemies - they'd never even accept the word "enemy" but make no doubt, their enemies thought of themselves as "enemies" - was deeply and terminally flawed.  And if I might add, Jeb Bush is exactly the same...a terminal blindness.

Cruz lost me when he left town for a fundraiser and didn't vote on the TPP or Iran. Then he voted for the Corker bill.

Keep in mind however, that "W" at the time Roberts was appointed had a Republican majority in both Houses.  It wasn't until 2006 that he had to deal with a Democrat majority. He was facing a lot of political pressure and heat from the American public on the war and as Cruz said, saw Roberts as easier to appoint.

Bush Sr., I feel is the less conservative of the two as he drafted NAFTA and of course raised taxes which sealed his fate.

I think JEB is the most liberal of the three and would be a complete disaster for conservatism, especially if we don't retain the majority in either House.

Talk about somebody who panders.  Ted Cruz is a specialist at sucking up to whomever he's in front of.

Lmao.  Obviously you don't know Cruz's background very well or have done any research on him.  Secondly, when Cruz spoke of Souter, he was referring to George "H" Bush, not "W"....and the article references his comments to gay marriage (my hunch was the comments was taken out of context).  I understood him to say that if the gay marriage issue would have happened under either Bush, the ruling would have come out the same because of the liberal rulings by both Souter and Roberts.  Thirdly, this is not the first time Cruz has taken "issue" with Roberts; Roberts wrote an opinion upholding the "Affordable Care Act".
