Although same-sex marriage is now legal in all 50 states, many same-sex couples - particularly those who have separated - would argue that custody of children and visitation rights are still unresolved issues.
In June, the Appellate Division, Fourth Judicial Department affirmed a decision made in Chautauqua County Family Court, in which a Jamestown woman was denied any legal relationship with a non-biological child whom she had helped raise with a former same-sex partner. The woman, according to the ruling, lacked standing to seek custody of, or visitation with the child because she had not married her partner or adopted the child.
