Supreme Court Tosses Out Obamacare’s Contraception Mandate

Posted by: Nicole Sanders on March 10, 2015

On Monday the Supreme Court threw out an appeals court decision which said the University of Notre Dame had to abide by Obamacare’s contraception requirement.

Notre Dame has long stated they are a religious institution and should not be mandated to pay for abortions that are against their beliefs. This case is the only one to pre-date the Hobby Lobby ruling.

In regards to Hobby Lobby, the court ruled in 2014 they could on religious grounds seek exceptions from the provision.

It was said in both cases religious rights are protected under the Religious Freedom Restoration Act.

This comprise allows the organizations to opt out and makes other insured pick up the tab.

The topic has been a big fight since Obamacare was enacted in 2010. Under the law employers are required to provide health insurance for their employees that include woman services such as abortion and sterilization. A lot of religious institutions condemn abortion and were outraged they were being forced to pay for it.

Little by little the Supreme Court has been chipping away at the bill. These cases are just the tip of the iceberg. A lot more lawsuits are expected to follow.

The case in question is Burwell, US Supreme Court, No. 14-392.
