Lindsey Graham urges Trump to reopen government for 3 weeks before declaring a national emergency

President Trump should reopen the federal government for three weeks before declaring a national emergency, according to Sen. Lindsey Graham.

"Before he pulls the plug on the legislative option, and I think we're almost there, I would urge him to open up the government for a short period of time, like three weeks, before he pulls the plug, see if we can get a deal," the South Carolina Republican said during an interview with "Fox News Sunday." "If we can't at the end of three weeks, all bets are off, see if you can do it by himself through the emergency powers, that's my recommendation."

But Graham, who has taken a high-profile role in discussions regarding the partial government shutdown given his close relationship with Trump and his interest in comprehensive immigration reform, warned that a legislative resolution to the funding impasse "is just about shut off." He repeatedly referred to the mock offer from House Speaker Nancy Pelosi, D-Calif., of $1 for the president's proposed southern border wall.

What is so magical about three weeks? Besides, if he reopens the government, gets nowhere, then declares the emergency, who is responsible for the next shutdown? This is basically like what Trump discussed in the campaign when he said it was foolish to tell the enemy when you are leaving. All they need to do is wait the prescribed amount of time.

Your problem Lindsey. Even if Trump wanted to open the government tomorrow, he can’t without an appropriations bill from congress.

There is no logic to his thinking.  Pelosi has said "NO".  Why does he think she'd change her mind?  They know that if Trump can't deliver on the wall, he loses in 2020.  This is about the DEMS taking the White House in 2020, nothing less or more.  Pure politics.

   YES, @libertybele there's been a remarkable improvement now that he's on his own but he still seems to be lost in the backyard, more often than not.  I don't trust him at all.

I haven't given up on Lindsey.  When he's on the right side, he is a great speaker and advocate.

But he's wrong in thinking there will be a deal from the Rats.

The President speaking with reporters this morning leaving the White House was asked about this.  He said he has rejected this suggestion; he want this solved, not pushed down the road.

As an advocate of using the emergency declaration device,  I like Graham's advice.   Open the government to give the Dems one last chance to negotiate before declaring an emergency.   It provides effective cover for a step that will then be tested in court.   Let's see if the Dems like their chances of prevailing.

First, it’s not up to Trump to open the Government. He must have a funding bill first.
Second, assuming both houses could pass a funding bill (probably not likely given to current political state of affairs between the two chambers), then Trump would have to agree and sign it.

If that were to happen (unlikely as it is), Trump could then invoke the emergency acts to do what Congress wouldn’t do in the funding bill.  Congress can override the emergency declarations, but would need to do it specifically as a seperate resolution which would not likely pass the Senate, not buried in the funding bill if he declared first which he would then have to veto.  It’s really a chicken or the egg scenario.
