Migrants traveling to US sue Trump, government; claim violation of constitutional rights

A dozen migrants traveling by foot from Honduras to the U.S. to seek asylum filed a class-action lawsuit Thursday against President Trump, the Department of Homeland Security and others, claiming a violation of their due process under the Fifth Amendment.

The Fifth Amendment states that, "no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law."

A recent PBS report cited former Supreme Court Justice Antonin Scalia, who ruled in 1993 case that "it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding."
Fart for freedom, fart for liberty and fart proudly.  - Benjamin Franklin

...Obsta principiis—Nip the shoots of arbitrary power in the bud, is the only maxim which can ever preserve the liberties of any people. When the people give way, their deceivers, betrayers and destroyers press upon them so fast that there is no resisting afterwards. The nature of the encroachment upon [the] American constitution is such, as to grow every day more and more encroaching. Like a cancer, it eats faster and faster every hour." - John Adams, February 6, 1775

See ya in court?
My avatar shows the national debt in stacks of $100 bills.  If you look very closely under the crane you can see the Statue of Liberty.

My favorite Ben Franklin quote - "Beer is proof that God loves us and wants us to be happy." :silly:

There are almost three hundred gang members in the invading horde that have been identified.

If this is true, who is paying their legal bills?  Even if the attorneys are doing the work pro bono, someone is paying the court costs.

Or are those denials by PBS, NYT and other supposed fact checkers that there is no one financing the invaders untrue?

Action

An Executive Order directs the Coast Guard to intercept vessels illegally transporting passengers from Haiti to the United States and to return those passengers to Haiti without first determining whether they qualify as refugees, but "authorizes such forced repatriation to be undertaken only beyond the territorial sea of the United States."

Ruling

United States Supreme Court
SALE v. HAITIAN CTRS. COUNCIL, INC., (1993)
No. 92-344
Argued: March 2, 1993    Decided: June 21, 1993

In Sale v. Haitian Ctr. Council, Inc., 509 U.S. 155 (1993),the U.S. Supreme Court held that the U.S. was not in violation of its non-refoulement ( forced return) obligation when it returned Haitians interdicted on the high seas because the Haitians were not within U.S. territory and therefore the non-refoulement obligation did not apply.

It seems that in the last ten years or so the sole purpose for the existence of The United States is to be an unassimilated boarding house for the Third World.
