West Virginia lawmakers vote to impeach multiple justices on state's highest court

By Brett Samuels - 08/13/18 07:10 PM EDT

West Virginia lawmakers on Monday voted to impeach three of the four sitting justices on the state’s Supreme Court of Appeals over corruption and misuse of state funds.

The Associated Press reported that the House of Delegates voted 64-33 to impeach Justice Allen Loughry, followed a couple hours later by a 56-41 vote to impeach Justice Robin Davis.

Lawmakers also voted around 6:30 p.m. to impeach Justice Elizabeth Walker, the AP reported.

Each of the justices will face a trial in the Senate to determine whether they will lose their seats on the bench as part of a widening corruption scandal that has engulfed the state's highest court.

Oh yeah, it's getting hairy. The Democrats in the House of Delegates were all gung-ho on this when they thought Justice Loughry (Republican) was the only one who was going to get in trouble. Now that Justices Davis and Workman, both Democrats, also are being charged, they're all, "Wait just a minute here!"

The absolute stupidest comment came from a Democrat delegate:  "This isn't occurring any longer. Why are we spending so much time on this unless we are just out to get somebody?"

Well, duh. It doesn't matter that a lawbreaker isn't committing an offense right at this very minute. If they did something, and the statute of limitations hasn't run, their offenses should be dealt with by the appropriate authority.

Speaking about one of the charges, specifically, that same delegate said: "I do not think this is clearly illegal ... I disagree that this is a valid article of impeachment. I think it's confusing <voice raises> and I don't think we should be impeaching people over something that's confusing."  *****rollingeyes*****

Even though judges in WV elected, they no longer run on a partisan basis, as of a few years ago. But we all know that Loughry and Walker are Republicans; Davis and Workman are Dems, and the one who resigned - Ketchum - also is a Dem.

Delegates advance impeachment articles against 4 W.Va. justices
By Brad McElhinny in News | August 13, 2018

CHARLESTON, W.Va. — Over the course of a long and contentious Monday, the House of Delegates approved articles of impeachment against four justices of the state Supreme Court.

Delegates voted to impeach Justice Allen Loughry — who faces 23 federal charges —and Justice Robin Davis on several articles, including their overspending on office renovations.

Loughry, Davis and Margaret Workman were all named in impeachment articles claiming they circumvented state law to pay senior status circuit judges more than they were entitled to be paid during fill-in stints.

Shortly before midnight, Justice Beth Walker was included with her other three colleagues on an article saying they had failed to do enough to hold each other accountable. ...

A second member of the court has resigned. Justice Robin Davis is acting terribly offended by the whole impeachment thing, but there's just something about spending over $500,000 in taxpayer funds to renovate an office in a state where the average home price is around $100,000 that makes her outrage just a little bit offensive.

CHARLESTON, W.Va. — Justice Robin Davis, who spent more than two decades on the West Virginia Supreme Court announced her immediate retirement amid impeachment proceedings.

Davis, who made the announcement in the Supreme Court’s chamber, blasted the impeachment process and said her retirement is the only way voters could have a say on who fills the seat.

“What we are witnessing is a disaster for the rule of law, the foundation of our state, and indeed, our very society,” Davis stated. “For when a legislative body attempts to dismantle a separate branch of government, the immediate effects, as well as the precedent it sets for the future, can only be termed disastrous.” ...

With Davis’s announcement, there are only two functioning, full-time members left on the court, justices Margaret Workman and Beth Walker, both of whom now face impeachment charges.  ...   More
Excuse me, I'm trying to squeeze out a tear for ex-Justice Davis.
