The most important fact about the case is that whataboutism will not work as a defense in court – especially in New York.

True. But once this goes to court and is immediately thrown out as baseless, the harm (undermining confidence in the president) will already have been done.

By now the establishment’s frenzied attempts to damage Trump politically should be obvious to all.

The Trump Family Foundation gave out more ($19 million) than it took in ($18 million); there are no expenses – $0, no salaries, no staff, nothing.

I'm trying to figure out how an organization does that? 

Did it borrow money to give out?  Did it take in donations that did not go into the accounting?

In the long run this is probably the move that guaranteed a Clinton Foundation audit and investigation.  Hillary will eventually, assuming she lives that long, rue this day.

Maybe or maybe not. Jmo, but I'm guessing part of Trump's uptick in popularity is due to more and more people waking up to the political motivation of Mueller's witch hunt. Iow, hounding and harassing a sitting president  could well be a losing strategy.  If so, count on the Democrats to double down on it.

Trump put his own money into the foundation. “Between 2001 and 2008, the president donated a total of $2.8 million” according to Forbes.

But, again why are we lending attention to an obviously politically motivated lawsuit?  Because it’s not really about infractions of paperwork and registration deadlines of the private citizen Donald Trump that the attorney general of NY is pursuing, it’s about an ongoing attempt to undo an election of a President that the establishment didn’t want.

Clinton was Secretary of State while receiving money from countries with business before the state department, for heaven’s sake!

If the allegations in the complaint are even partially true, this won’t be thrown out as baseless.  NY law can be pretty harsh on non-profit managers who fail to punctiliously follow the rules.

Whenever these things happen, I remember, Trump has been in the public eye for 40 years or more, he's been in business for a very long time. Why haven't these things happened before?  Why hasn't he been caught on these?

The reason Trump wasn't caught was because he was a Democrat then.  They ALWAYS get a pass  Now that he is changed party affiliation the shoe is on the other foot.

Okay thanks!  I was trying to understand how that statement was even possible.  It was donated money; it included money from Trump that wasn't part of the $18 million

Probably roll over from a prior year. For example, the foundation may hold $20m in assets. The next year Trump sees his he needs to bring some asset holding value down so he donates $19 million to his own foundation. That foundation then donates $20 million to other foundations, so the foundations holdings on hand are $19 million.  Not saying this is the case with the Trump foundation, but for similar foundations (Clinton   cough cough) sometimes they end up donating to other family run foundations which is where the real expenses are and how this one shows no expense. Foundation A is just for holding and distributing. Foundations B-Z get money from A and do whatever with it. B-Z have the staff, parties, expenses, pumping it back to family and friends, wedding dresses, etc.

Keep in mind, he said he wouldn’t settle the Trump University case in the same jurisdiction.  He ended up settling for $25M.

It has happened before, constantly. He has been party to over 3000 lawsuits and investigations. Hell, his first appearance in the New York Times in the early 70s after he took over the family business was the Nixon Administration going after him for racist renting practices.

So is theirs.  He had better hope it’s settled and doesn’t come down to a deposition.  The ones he’s previously done have been decidedly underwhelming.  For someone so invested in his reputation as a negotiator and executive, it’s stunning how uninvolved he actually is when under oath.  Check YouTube for past records when he took the stand.
