Who is Responsible for U.S. immigration policy?
by Jennifer Chacon
Who controls the nation’s immigration laws? Although the question seems straightforward, the historical picture is mixed, and the text of the U.S. Constitution does not point clearly to the answer. While the Constitution’s text and the various Supreme Court cases interpreting this text suggest that the federal governÂment has the exclusive power to enact and enforce the nation’s immigration laws, state and local authorities still play an important role in the regulation of immigration because they shape the conditions of daily life for immigrants in their jurisdictions.
