For the second time in two weeks, a visiting judge has removed 19th State District Judge Ralph Strother from presiding over a case involving a biker arrested in the 2015 Twin Peaks shootout.

Christopher Jacob Carrizal, the 36-year-old president of the Bandidos Dallas chapter, is still slated to go to trial Tuesday. However, Judge Matt Johnson, not Strother, will be there in an attempt to impanel 150 potential jurors who have been summoned for Carrizal's trial. The final jury panel would then be selected from that group.

Carrizal's attorney, Casie Gotro, of Houston, said she will file a motion to recuse Johnson on Tuesday morning, which would put a halt — at least temporarily — to Johnson's involvement in the case.

Regional administrative Judge Billy Ray Stubblefield has contacted a judge to hear the recusal motion if Gotro makes good on her pledge to try to remove Johnson, who said he will not step aside voluntarily. That hearing could be held as early as Tuesday morning, court officials said.

Stubblefield appointed Retired Judge Dan Mills, a longtime former federal prosecutor, to hear the recusal motion against Strother. After a six-hour hearing Monday, Mills, like retired Judge James Morgan last month, applied the "reasonable man-on-the-street" test to the question and removed Strother from Carrizal's case.

The test, as the judges explained it, is whether the average person viewing the situation would wonder if the judge was being fair.

Gotro, who continued her sparring match with prosecutor Michael Jarrett during the hearing, said she would seek to remove Johnson because the facts are the same for both judges. Gotro said last week that she only met Johnson briefly for the first time Aug. 25 when the Carrizal jury panel reported for the first time.

One day after a visiting judge yanked 19th District Court Judge Ralph Strother off the first Twin Peaks biker trial, the defense attorney for defendant Jake Carrizal -- a member of the Bandidos motorcycle club -- filed a motion to also recuse the new Judge Matt Johnson from presiding over the case.

The move delays Carrizal's jury selection for yet another day. A deputy clerk told the jury to leave and return Wednesday at 9 a.m.

A panel of about 150 showed up for jury duty in tjhe Twin Peaks biker trial. Many of them were angry that the selection process was stopped.

The motion's filing was no surprise. Defense Attorney Casie Gotro had previously stated she would file such court documents and implied she believed Johnson and Strother would both be biased toward the prosecution.

Jury selection in Twin Peaks trial delayed again after defense attorney files recusal of second judge

WACO, TX (KXXV) -

The jury selection process in the first Twin Peaks trial has been delayed until Wednesday.

On Tuesday morning, dozens of potential jurors showed up for jury selection in the trial of Christopher Jacob Carrizal, the president of the Dallas chapter of the Bandidos.

On Monday, visiting Judge Dan Mills recused Judge Ralph Strother from the case. On Tuesday, Judge Matt Johnson started the jury selection process.

Carrizal's attorney Casie Gotro, who caused the delay of the hearing on Tuesday, walked into the courtroom and asked the judge to speak with him.

Minutes later, District Clerk Jon Gimble announced "This saga is going to drag one more day."

The 150 potential jurors were asked to come back Wednesday morning. This is at least the third time, the jury selection has been postponed.

The selection process was halted after Gotro filed a recusal motion for Johnson. The judge filed an order soon after stating he would not recuse voluntarily and referred the case to the administrative judge for the 3rd Judicial Region Judge Billy Stubblefield.

The potential jurors who had been summoned for the first Twin Peaks trials have been dismissed.

Christopher "Jacob" Carrizal, the president of the Dallas chapter of the Bandidos, is the first biker expected to go on trial.

The potential jurors had attended court three times without the process of impaneling the jury starting.

The last two times they appeared in court, they were sent home after defense attorney Casie Gotro filed a motion to recuse judges Ralph Strother and Matt Johnson.

Strother was recused from Carrizal's trial. Johnson is expected to preside over the case.

On Wednesday morning, the defense attorney and the District Attorney's Office met prior the jury was requested to appear. At that time, they decided to dismiss the jury.

Gotro said the jury was dismissed because of a need for a pre-trial conference with Judge Johnson before moving forward.

The pre-trial conference is expected to take place on Monday at 9 a.m.

Another jury pool could be summoned for September 29.

Judge Johnson and prosecutor Abel Reyna have enjoyed a longstanding personal and professional relationship. They’re former law partners, and Reyna contributed the maximum amount allowed by state law to the judge’s political campaign.
