LONDON, England, July 7, 2017 (LifeSiteNews) – The hospital fighting to take Charlie Gard off life support announced today that it's asked the High Court to reconsider the case based on new evidence that needs to be considered.

"We have just met with Charlie’s parents to inform them of this decision and will continue to keep them fully appraised of the situation," Great Ormond Street Hospital said in a statement Friday.

At what point did the parents lose their parental right to discharge their son from the hospital? The UK NHS has a form for "discharges against medical advice" see: https://www.ntw.nhs.uk/section.php?l=4&p=843

Only a couple of vague things I have seen in the press...one of which is "When parents do not agree about a child’s future treatment, it is standard legal process to ask the courts to make a decision. Which doesn't make any sense at all (I think both parents wanted the experimental gene therapy in the US?? Maybe not.)

When/why did the guardian happen?

Anyone have further info.?

To answer my own question:  Turns out that it isn't directly related to socialized medicine (although that adds monetary pressure to the issue)...it has to do with UK child welfare laws. The US has similar laws, but they give more leeway to the parents, but the parents in the US can still be overridden in cases like Jehovah’s Witnesses or Christian Scientists and blood transfusions. In the UK the hospital or doctor can petition the court on behalf of the child and a judge has to make a ruling. In the US they cannot directly do that. For more information see:

The parents of the little boy Charlie Gard, who had been fighting a hospital to save his life say they are ending their legal battle to get him an experimental treatment.

Chris Gard and Connie Yates wanted to take their son to the United States for an experimental treatment. They raised more than $1.5 million for his care. His parents said they know the chance of the experimental treatment working is slim, but they want to try anyway for Charlie’s sake.

But today, Charlie’s parents announced their decision at a hearing today at the British High Court. They made their announcement as a judge was prepared to oversee the latest round of a legal battle that a stressed over the last five months.

A lawyer representing the couple told Justice Francis that “time had run out.”
