The Republican-controlled legislature in Ohio sent Governor John Kasich a bill last night that would ban most abortions in the state. The "Heartbeat Bill" would make abortions illegal if a fetal heartbeat can be detected. That could be as early as six weeks into pregnancy.

Gov. Kasich has questioned the constitutionality of the law, which would be among strictest abortion rules in the country.

Once a heartbeat is detected, there can not be an abortion. That is per these stories, usually at 6 weeks.

Since a functioning heart beat, or the absence thereof, has long been used by the medical community to determine life or death, this is a reasonable measurable criteria for establishing "separate" life.

Banning abortions after viability is Constitutional,  but not after the first indication of a heartbeat. Kasich can and should veto this bill.

Sophistry of a truly Dred-Scottian magnitude:  "In the opinion of the court, the legislation and histories of the times, and the language used in the Declaration of Independence, show, that neither the class of persons who had been imported as slaves, nor their descendants, whether they had become free or not, were then acknowledged as a part of the people, nor intended to be included in the general words used in that memorable instrument."

The fact that the enslaved were actual people, with the rights endowed them by the Creator, had no part in Taney's decision.  A similar argument can be directed to you.

Again, if New York state has some years of high abortion rates, over 30 per 1000 cases of pregnancy and a state like Wyoming has had some years of only 3 per 1000 cases of pregnancy, why should states have to have the same kinds of laws?
