Hillary Repeatedly Answers 'Do Not Recall' in Email Lawsuit Testimony

Former Secretary of State Hillary Clinton has submitted written answers to questions about her private email server on Thursday, saying 20 times that she did not recall the information being sought or discussions she was asked about, Politico reports.

The questions were asked by lawyers for the conservative watchdog group Judicial Watch, which had requested to talk to Clinton in person. Instead, U.S. District Court Judge Emmet Sullivan allowed the group to submit questions in writing.

Clinton, the current Democratic nominee for president, said she also was never warned that using a private email server could put her in violation of rules of persevering federal records.

"Secretary Clinton states that she does not recall being advised, cautioned, or warned, she does not recall that it was ever suggested to her, and she does not recall participating in any communication, conversation, or meeting in which it was discussed that her use of a clintonemail.com e-mail account to conduct official State Department business conflicted with or violated federal recordkeeping laws," Clinton's lawyers wrote.

She signed the filing on Monday "under penalty of perjury."

Republican critics have charged Clinton used the homebrew server in an attempt to skirt Freedom of Information Act requests.

Her lawyers responded:

"Secretary Clinton does not recall whether she had a specific expectation that the State Department would receive FOIA requests for or concerning her e-mail. She understood that, because her practice was to e-mail State Department staff on their state.gov accounts, her email was being captured in the State Department’s recordkeeping systems....Secretary Clinton understood that e-mail she sent or received in the course of conducting official State Department business was subject to FOIA."

Clinton's answers generally mirrored those she gave to the FBI this summer, Politico reported, and her campaign spokesman Brian Fallon echoed those sentiments in his response.

"Judicial Watch is a right-wing organization that has been attacking the Clintons since the 1990s, and this frivolous lawsuit is just its latest failed attempt to hurt her campaign for the presidency," Fallon said.
