The death of Supreme Court Justice Antonin Scalia doesn’t merely mark a tragedy for Constitutional philosophy – it may mark the death of American Constitutionalism as a whole.

Scalia’s philosophy of jurisprudence is well-known and shaped two generations of conservative thinkers: the Constitution ought to be interpreted according to its original meaning. This shouldn’t have been a groundbreaking notion given that most legislation is interpreted according to those rules, but because leftist jurists have spent a century chiseling away at the meaning of the Constitution based on their personal political beliefs, Scalia’s reinvigoration of traditional interpretive methodologies made him a historic figure. Scalia’s brilliant, passionate writing style made him author of some of the most famous dissents in Supreme Court history, and channeled the modern conservative frustration with the continuing abandonment of the Constitution.

Scalia’s jurisprudence also reminded conservatives that there is no substitute for proven Constitutional originalism. Most conservatives ignored that when they greenlit the appointment of cipher John Roberts for Chief Justice of the Supreme Court, a point I made when he was appointed. But Scalia provided a consistent reminder that Constitutional philosophy matters. It isn’t just a game of doing whatever you want politically. Constitutional jurisprudence is about recognizing the limits of the federal government – and recognizing the limits of the politicization of the Court itself.

In the end, Scalia’s death could mark the end of the Constitution itself. That’s because the current Supreme Court rested, until Scalia’s death, on the vague, confused, indeterminate philosophy of Justice Anthony Kennedy, who apparently decides cases on the basis of whether he has a solid bowel movement that morning. That means that half the time, the Constitution has a shot, as in Citizens United; the other half of the time, the Constitution drains away into the mists of Kennedy’s magical social justice thinking, as in Obergefell.

Unlike Kennedy, Scalia represented a consistent vote for a Constitution beyond modern progressive power politics. But with his death, President Obama now has the power to appoint a fifth justice to join hard-left social engineers Elena Kagan, Sonia Sotomayor, Stephen Breyer, and Ruth Bader Ginsburg. If the Republican Senate allows President Obama to select Scalia’s successor, the left will have a complete monopoly on the Supreme Court. Within the next few years, Citizens United will be overturned, restoring limits on free speech; the Supreme Court will render the Second Amendment meaningless by reinterpreting the right to bear arms as a non-personal right; freedom of religion will be made subservient to same-sex marriage and abortion priorities; the death penalty will be ruled unconstitutional; unions will be allowed to continue confiscating the dollars of people who disagree with them politically; redistricting along leftist lines will return. Scalia ensured that the Supreme Court wasn’t a transformative institution; now it will become the chief tool in the left’s arsenal.

It’s a sad commentary on the state of conservative politics that the only thing standing between the United States and the death of its founding document was a brilliant 79-year-old jurist. But unless Republicans stand up on their hind legs now, that will certainly be the case.

As the nation and official Washington prepared to mourn the late Supreme Court Justice Antonin Scalia, watchers of the high court began to assess the immediate impact of his death on several pending cases whose decisions might have had momentous political implications.

Among these is Friedrichs v. California Teacher’s Association, set to have been a landmark case regarding the mandatory collection of union dues and their use for political purposes. The ruling could have meant the death knell of collective bargaining and the political might of America’s unions.

After oral arguments in the case in January, The Washington Post indicated the court’s conservative majority, including Scalia, were leaning to rule against the unions ability to collect mandatory dues.

But Scalia’s passing – and the news that the Republic-led Senate will likely not confirm an Obama nominee — means such cases could up with 4-4 decisions. Lacking a majority, the lower court’s rulings will stand.

In the Friedrichs case, the 9th Circuit Court of Appeals had ruled in favor of the teacher’s union.

Had the Supreme Court ruled that union dues could not be used for political purposes, it would have dealt a major blow to one of the Democratic party’s most powerful assets.

Another key case is U.S. v. Texas, in which opponents challenged the legality of the president’s executive orders dealing with illegal immigrants.

Signs are now strong that it will be decided at the lower court level and the Supreme Court will not deal with it.

But court experts suggest that Chief Justice John Roberts could potentially push through rulings in cases like Friedrichs, where oral arguments were heard, using Scalia’s vote.

"Supreme Court justices take a vote on a case at their meetings that they hold immediately after oral argument," Hans von Spakovsky, Senior Legal Fellow at the Heritage Foundation, told Newsmax, "So on cases that have already been argued, even if no opinion has been written yet, the chief justice has an obligation to include Justice Scalia's vote in those cases.”

But, he added, "unfortunately, in other cases where no vote has yet been taken, we may get tied votes — which means the lower court decisions will stand. That means that a number of controversial issues will have to be brought back to the court in new cases when there are nine justices."

Not all legal experts agree with the view Roberts could issue a decision using Scalia’s vote.

"Unless a justice is sitting at the court at the time of argument and at the time the decision is issued, the justice's vote doesn't count," Samuel Bagenstos, a University of Michigan Law Professor who clerked for Justice Ruth Bader Ginsburg, told NBC News.

Mr. Poindexter was the one who helped get Justice Scalia declared dead w/o an actual medical examination. (It was apparently done over the phone based upon his descriptions of the Justice's condition) He was also the one who was the link between Justice Scalia's death and the response of federal authorities.

No autopsy was ordered...

I'm surprised his family did not request an autopsy.  Really surprised.

The far left does not and never has believed in the USC, the right grudgingly goes along with it, but no matter left or right the USC is in the way of they goal of tyranny.  Never kid yourself into thinking the right is on the level, the up and up and wants anything by power.  As long as we allow career politicians then their lust for power will go unabated.


In order to stop this the only choice has to be, NOT term limits, but rather create self-imposed limits by not allowing any retirement from any elected office and to have your (and your family) tax returns full audited durning you entire term and for 10 years after leaving office.


We need to stop people who are public servants making $175k per year become worth $MILLIONS while working in office, harry reid, joe biden family and just about every public official gets filthy rich while in and after office.

Well, keep in mind, none of us know what Maureen Scalia has said, or asked, about any of it.  We are all dependent on a media report (likely a single source that is just repeated over and over) that said she didn't want an autopsy to be performed.  It may be the truth, or it may not.  We simply don't know at the present.

If the reported timeline is accurate, I am not sure that a sudden grief-stricken widow, would be in a position to make a sound judgement about that within hours of being notified.  The reports that I have seen say that he arrived at the funeral home at 2:30AM Sunday, and was already embalmed by 3:30AM.  I am not sure at what point between being notified Saturday afternoon, and that point in time, her desires were to have been stated.   :shrug:

Obama nominates Cruz, he weakens the senate, takes out a strong presidential candidate at the cost of possibly a couple of supreme court rulings and enhances the dems chance at winning the white house back...

I have been highly suspicious since the beginning. The timing was too perfect. I tend to be skeptical of such things.

But we'll never know for sure. In spite of there being a couple of suspicious anomalies to the timeline of events, even an autopsy likely would have revealed nothing. They certainly wouldn't have sent in the B-team for such a high profile figure in such a critical situation, and they would have made no mistakes.

Cruz is probably the best candidate Obama could nominate. Assuming Cruz accepted the nomination (and I would strongly encourage him to do so), it would be a short-term loss maybe for the Presidency, but by all means a long-term win for the country.

I agree, though, it would NEVER happen.
