Gov. Nixon Calls For ‘Vigorous Prosecution’ Of Darren Wilson

Not content with a regular prosecution or a vigorous investigation, Missouri Gov. Jay Nixon said he hopes that Ferguson, Missouri, police officer Darren Wilson will receive a “vigorous prosecution” in the shooting death of Michael Brown on Aug. 9.

“A vigorous prosecution must now be pursued,” Nixon said in a five minute video address posted to his website Tuesday.

“The democratically elected St. Louis county prosecutor and the attorney general of the United States each have a job to do,” said Nixon, a Democrat.

“Their obligation to achieve justice in the shooting death of Michael Brown must be carried out thoroughly, promptly, and correctly,” said Nixon of investigators.

U.S. Attorney General Eric Holder plans to visit Ferguson on Wednesday to meet with federal law enforcement officials and community leaders. Forty FBI investigators traveled to Ferguson over the weekend to interview witnesses.

Nixon has not directly justified his call for a strong prosecution. He has not indicated that he has any information on the shooting that has not been made public.

Wilson, a six-year police veteran with a clean disciplinary record, has not even been arrested or charged with a crime. A grand jury is set to convene on Wednesday to determine if he will be charged.

Wilson, who is on paid leave during the investigation, has reportedly claimed that he shot Brown after the man hit him in the face and struggled to gain control of his service weapon.

Several eye-witnesses who gave media interviews shortly after the shooting have said that Brown was surrendering with his hands up as Wilson shot him.

Wilson is reportedly claiming the Brown ran towards him before the fatal shots were fired. The interviewed witnesses have claimed that they did not see Brown running at Wilson. An unnamed witness unwittingly captured on video talking about what he saw unfold said that he saw Brown move towards Wilson.

A private autopsy commission by the Brown family determined that he was hit with at least six bullets, two in the head and four on the right arm.

An inconsistent release of information and a heavy-handed police response to demonstrations in Ferguson has led to heavy criticism for police, as well as Nixon.

He was perceived as failing to address the shooting soon enough.

“We have a responsibility to come together to do everything we can for this family, peace for this community, and have the courage to address the problems that have divided us for too long,” Nixon said, citing the problems “of poverty, education, and race.”

Nixon, who said he recently met and prayed with Brown’s mother, called Ferguson “a test.”

“So I ask that we continue to stand together as we work to achieve justice for Michael Brown, restore hope and peace to the streets of Ferguson, and march together toward a future of greater opportunity for all of us.”

“This is hard,” said Nixon. “Nothing about this is simple.”

Evidence? Who needs evidence. We’re all good Democrats here.


“A vigorous prosecution must now be pursued,” Governor Jay Nixon declared. “The democratically elected St. Louis County prosecutor and the Attorney General of the United States, each have a job to do.”

Their job isn’t to conduct a vigorous prosecution, but to determine if there is any basis for such a prosecution. So far the weight of the evidence is against it.

If anyone should be prosecuted, it’s Nixon who took marching orders from Obama, shoved aside the Ferguson police, replaced with Captain Johnson’s “Hug a Rioter” approach leading to chaos and looting. Then he panicked and called for the National Guard.

Nixon wanted to suppress the Michael Brown robbery video and now he’s demanding a prosecution before the investigation is anywhere near done. And there’s nothing resembling a preponderance of evidence justifying one.

Right now there’s more evidence that this Nixon should join the other Nixon by being removed from office than that Darren Wilson should be vigorously prosecuted.

People are really getting sick of the political thuggery from Washington.

Missouri Gov. Jay Nixon is a national embarrassment

As new details regarding the death of 18-year-old Ferguson, Mo., resident Michael Brown slowly come to light, some casting doubt on previous media narratives, Gov. Jay Nixon, D-Mo., has proven to be nothing short of a national embarrassment.

Indeed, from his tardy response to an event that occurred nearly two weeks ago to his fumbling remarks regarding Darren Wilson, the police officer at the center of the tragedy, Nixon’s handling of the volatile and often violent situation in Ferguson has been inexcusable.

When he's not shirking his responsibilities and hiding from a situation that requires some form of leadership, Nixon is jamming his foot in his mouth all the way up to the knee.
 
“From the outset, I have been clear about the need to have a vigorous prosecution of this case, and that includes minimizing any potential legal uncertainty,” the Missouri governor said Tuesday in a statement posted online.

This remark is problematic for two reasons.

First, the governor has not been clear “from the outset” on the situation in Ferguson. As I have noted, Nixon shamefully hid from the initial chaos following Brown’s death, responding only after the outcry from the media became too great to ignore.

“If people got things to say, they’ll say them, and if people from the news media want to cover stuff and take pictures of things, they ought to do it. We live in a free country,” Nixon eventually said at a gathering that took place a full five days after the shooting. “That voice needs to be heard, and we want to help make sure that it is heard. It doesn’t much matter to me how respectful it is, it’s just got to be safe.”

Second, Nixon's “vigorous prosecution” remarks have confused good-faith efforts made by investigators to get to the bottom of the shooting, leading to confusion over whether the Missouri governor had called for the prosecution of Wilson.

Indeed, Nixon’s remarks were so unclear that a spokesman for his office was forced to clarify them.

“The governor’s comments yesterday were not intended to indicate prejudgment in this matter," Nixon spokesman Scott Holste said Wednesday in a statement to U.S. News.

“The governor used the term ‘prosecution’ to refer to all duties and responsibilities of the prosecuting attorney, including the exercise of prosecutorial discretion; whether and what evidence to present to the grand jury; the filing of criminal charges if supported by the evidence; representing the state if charges are brought; and ultimately ensuring that justice is served,” Holste added.

But the damage has already been done: Several media analysts and lawmakers had already seized on Nixon’s remarks and questioned whether the governor had chosen a side in the ongoing investigation.

“It’s really heartbreaking to see a man elected to an office that high in our state government, the chief executive of Missouri state government, come out with a statement like that that does prejudge the case,” Missouri Lt. Gov. Peter Kinder, a Republican, said in an interview Tuesday.

So it appears that when he’s not shirking his responsibilities and hiding from a situation that requires some form of leadership, Nixon is jamming his foot in his mouth all the way up to the knee.

Missouri’s governor has proven in the case of Ferguson to be incompetent, flailing, inattentive, fumbling and paralyzed by the events around him. He has failed entirely to take control of the situation, delegating the heavy lifting to his subordinates, and his feigned "outrage" at the behavior of state law enforcement officials is most likely an act meant to placate an angry press.

Nixon has led from behind, stumbling all along the way, and for this, he is a great national embarrassment.
