The White House is drafting an executive order that would ban federal contractors from discriminating against their employees on the basis of sexual orientation.

"Following on his pledge for this to be a year of action to expand opportunity for all Americans, the President has directed his staff to prepare for his signature an Executive Order that prohibits federal contractors from discriminating on the basis of sexual orientation or gender identity," a White House official said Monday.

"The action would build upon existing protections, which generally prohibit federal contractors and subcontractors from discriminating in employment decisions on the basis of race, color, religion, sex, or national origin," the official continued. "This is consistent with the President’s views that all Americans, LGBT or not, should be treated with dignity and respect."

The official noted that President Obama had merely asked his staff to prepare the executive order, declining to give a timeline for his signature. That distinction seems intended to give Republicans in the House a chance to take legislative action before the president moves forward unilaterally.

Obama has for months resisted calls from gay rights groups to draft such an order, with White House aides saying the president wanted Congress to pass legislation extending antidiscrimination protections to all American workers. But after passing the Senate in November, legislation has seen little progress in the Republican-controlled House.

"While work remains to ensure that all Americans, regardless of sexual orientation or gender identity, are equal under the law, we look forward to continuing to make progress in the months and years ahead," the White House official said.

Action in the House though seems unlikely. Top Republicans, including House Speaker John Boehner (R-Ohio), have called the bill redundant and warned it would cost jobs by creating frivolous litigation.

Earlier this year, Vice President Biden said there was "no downside" to such an executive action, although he emphasized the administration remained focused on passing broader legislation.

Following those comments, press secretary Jay Carney said there was "no doubt that the legislation would be a far greater accomplishment and more broadly applied.

“That is why we continue to push the House to follow the Senate's lead and pass that," said Carney.

Sen. Jeff Merkley (D-Ore.), who sponsored the Employment Non-Discrimination Act (ENDA) in the upper chamber, praised the White House decision and urged GOP lawmakers to act.

“With this announcement, the arc of history bends a little farther toward justice. Discrimination simply has no place in American workplaces. This executive order will allow millions more Americans to go to work empowered with the right to do their jobs free of harassment or discrimination,” he said in a statement.

“Most Americans don’t know that it’s still legal in many states to fire someone for their sexual orientation or gender identity. That’s because it not only defies common sense, it goes wholly against who we are as a nation,” Merkley added. “No more excuses. It’s way past time for Speaker Boehner to allow ENDA to have a vote in the House.”

DNC Chairwoman Debbie Wasserman Schultz (D-Fla.) called the move a “significant step in our nation’s progress on civil rights” and noted that it came almost one year after the Supreme Court struck down key parts of the Defense of Marriage Act.

“Democrats in Congress remain steadfast in our commitment to passing the Employee Non-Discrimination Act into law that will permanently extend these protections to all Americans,” she added. “It’s time for Republicans to join us.”

Obama is slated to headline a Democratic National Committee LGBT event on Tuesday in New York.

I take so much comfort from Obama's leadership - not allowing himself to be distracted by global fires and such.

yah...this ought go over like a lead balloon at a number of union halls across the nation.....any time one of them works on a Federal project they are a defacto Federal Worker and their boss's company is a Federal Contractor.

What this means is that at a future point a federal contract is going to carry a requirement that a certain percentage of workers, and ever a percentage of the sub-contractors on the job MUST be homo/trans owned.  It already happens with requirements for minority and woman owned businesses.  Competency for the job has absolutely nothing to do with their selection, only that they fulfill the Politically Correct codicils of the contract.

This has a broader impact than is first apparent.

Any business that sells any portion of its products to the federal government is defined as a 'federal contractor'.  e.g., many food companies sell products to U.S. commissaries.  They are 'federal contractors'.

It will be interesting to see if the Feds start losing suppliers...

Obama to Sign Executive Order on LGBT Bill Not Passed by House

President Obama was preparing an executive order Monday to prohibit federal contractors from discriminating against individuals based on their sexual orientation or gender identity.

The order will essentially force a bill that was approved in the Senate but hasn’t been taken up in the House, the Employment Non-Discrimination Act.

“It is a critical step forward in protecting LGBT workers in the workplace, and a change that I urged the president to make in a letter I signed to him,” said Rep. Adam Smith (D-Wash.). “In many states, a person can legally be fired or denied a job simply because who they are, or are perceived to be, a gay, lesbian, bisexual, or transgender individual. This is unfair and wrong.”

In November, House Speaker John Boehner’s (R-Ohio) spokesman said he would not support ENDA because “this legislation will increase frivolous litigation and cost American jobs, especially small-business jobs.”

GOP aides also stressed that protections for gays and lesbians already exist under law.

“Speaker Boehner has refused to bring ENDA to a vote on the House floor,” Smith said today. “I am a cosponsor of ENDA in the House and continue to urge its passage. No one should be denied rights because of who they love, and I will continue to fight for LGBT equality.”

“The action would build upon existing protections, which generally prohibit federal contractors and subcontractors from discriminating in employment decisions on the basis of race, color, religion, sex, or national origin. This is consistent with the President’s views that all Americans, LGBT or not, should be treated with dignity and respect.”

Rep. Adam Schiff (D-Calif.), an original co-sponsor of ENDA, called Obama’s action “important, and a welcome first step while we wait for the Republican leadership to bring up the Employment Non-Discrimination Act – which passed with strong bipartisan support in the Senate –- for a vote in the House.”

“With the House leadership thus far preventing a vote, it was time to use every avenue available to fight discrimination against LGBT Americans,” Schiff said. “Nevertheless, this does not free Congress from the responsibility to pass ENDA and protect all workers from discrimination and we continue to call for such action.”

Republican supporters of ENDA included Sen. Jeff Flake (R-Ariz.), who said in November that he voted for the Senate version because “one of the most important constitutionally mandated functions of the federal government is to protect the rights of individuals.”

While Flake had reservations about the bill, which extended protections beyond the 2007 version he supported the House, “I believe supporting this bill is the right thing to do.”

“I am hopeful that the bill moves forward in a way that works for employers as well as employees,” he said.
