ATF Defies Court Order, Raids Gun Stores, Takes Customer Lists

Do you know what an 80% receiver is?  No, I’m not talking about an injured NFL player, but something that involves firearms.  According to Tactical Machining’s website:


“What is an 80% receiver?

“An 80% Receiver is a partially completed piece of material that requires special tooling and skills to be completed and considered a firearm. Unlike a firearm receiver it is not required to be transferred through a Federal Firearms Licensed holder (FFL).

“Legalities

“A lot of questions have been raised about how our 80% AR-15 Lower Receivers can be considered non-firearms. We've received a determination letter from the ATF stating that the ATF does not view this as a firearm because to complete the receiver it requires specialized skills and tooling.

“Do I need an FFL to make a firearm?

“In a short answer, no. As long as you can legally own the firearm in the state, county and city you reside in you are allowed to manufacture a firearm for your own personal use. No serial number is required however it is suggested to engrave a serial number, model and manufacturer on your receiver in case it is lost or stolen.”

Now that you have that vital information, be it known that some ATF officials do consider 80% receivers as a legal firearm and are taking action against gun dealers who sell them.

Last week, Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE or BATF or years known just as the ATF) agents raided four Ares Armor stores in the San Diego area.  Dimitrios Karras, Executive Officer for Ares Armor described the raids:

 



“There were women and children inside our retail establishment when the (ATF) agents came in with guns drawn.  They came into our manufacturing facility with their guns up like they were invading Iraq.”

Ares Armor was aware of the ATF intentions to confiscate their polymer 80 percent lower receivers and they obtained an injunction against the seizure just three prior to the raids.  The injunction was issued because the legal status of the polymer 80 percent lower receivers is under question as to whether or not they are a firearm.  But that didn’t stop the ATF agents, who not only seized all of the 80 percent receivers in question, but they also took all of the stores’ customer lists with all of their information.

Karras commented about the raid and seizure of the customer lists, saying:


“If anybody is a criminal organization that should be investigated, I think they should look in the mirror. We gave them a black eye publicly.  They tried to do an underhanded deal with us. They said, ‘Hey hush, hush. Keep it secret and nobody’s going to know that we took the customer list from you. Nobody’s going to know we took this from you.’”

Now customers of the store are getting nervous, fearing that the ATF will use customer information to raid their homes.  One customer who did not want to be identified told the local news:


“I’m on that list, and I’m waiting for the knock on the door to tell me they are here to remove my second amendment rights.”

This is just another sign of how the Obama administration completely disregards the law and pushes their socialist agenda against the American people.  The guns stores had a legal court injunction blocking the raid until the legality of the 80 percent receivers could be resolved in the courts, but the ATF ignored the injunction and conducted the raids anyway.

President Obama is bound and determined to violate our Second Amendment rights to bear arms because he cannot effect a complete socialist takeover with 300 million firearms in the hands of private citizens.  He has to disarm us first and that is why the ATF had been raiding more and more firearms stores since Obama took office.  We are faced with only two outcomes in this struggle:  One is to remove all of the anti-gun liberals from public office.  The other outcome will be a bloody revolution in this country in which thousands, perhaps millions of Americans will die.  I’m praying for the first outcome, but am prepared for the second if need be.  Are you?

Perhaps the only solution is for gun stores to destroy all existing customer lists, and keep only [I think they're called] the "4473"s as required by law.

There is are now browsers designed to let you surf the net anonymously (Tor and Epic come to mind).

Gun stores should make it possible for buyers to "buy anonymously" to the fullest extent of the law.

I won't be surprised when the state of Connecticut uses such tactics to identify those weapons owners who haven't "registered" their AR type rifles and such (heck, under CT law, even the Smith & Wesson MP 15/22 -- a .22 rifle -- is now classified as an "assault weapon" and banned from sale).

Gee.  Do you suppose DEA could do the same thing to recreational marijuana stores??  How about the dispensaries and the growers who supply them??

Have they gone back to court to get an order of contempt for violating the injunction?  They should also consider suing the agents in their individual capacities because they were breaking a known lawful court order and were therefore acting outside the scope of their lawful authority.
