The 9th Circuit is frequently just a stepping-stone formality to get to the Supreme Court.

School districts have always been able to decide what students wear, how long their hair can be, etc.

This was a loser from the start, and the Supreme Court won't even take it up.
Roy Moore's "spiritual warfare" is driving past a junior high without stopping.

School districts have always been able to decide what students wear, how long their hair can be, etc.

This was a loser from the start, and the Supreme Court won't even take it up.

They have always had wider discretion than most, however, that discretion is not unbridled.

Maybe not, but what students wear has always been in the purview of district administrators.  Otherwise, they wouldn't be able to enforce requirements for uniforms.

The orders they gave were not part of a considered policy and were not part of enforcing a uniform dress code; they were an impromptu (I would say knee-jerk) reaction to a very speculative worry and were imposed in a partial, not an impartial, manner.  I agree that the case is not a slam-dunk, but I think that goes both ways.
