The cross is on privately owned property.

However, because of the Mayor's intimate involvement - he was one of the two people who formed the LLC that acquired that private land - the town, the LLC, and everyone else may still get drawn into an ugly lawsuit, which will be costly, even if they ultimately win.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


 ... Just words on paper. Anti-religion Nazis have finely tuned the art of selective reading. They have an innate ability to see the establishment clause but are somehow blind to the prohibition part of the First Amendment.
