Ex-Clinton Aide Expected to Join Obama

WASHINGTON — President Obama, after a rocky year that leaves him at the lowest ebb of his presidency, is bringing into his White House circle the longtime Democratic strategist John D. Podesta, a former chief of staff for President Bill Clinton.
Mr. Podesta, who has agreed to serve as counselor for a year, led Mr. Obama’s presidential transition in 2008 and has been an outside adviser since then. He also has occasionally criticized the administration, if gently, from his perch as the founder and former president of the Center for American Progress, a center-left public policy research group that has provided personnel and policy ideas to the administration.

Word that Mr. Podesta would for the first time join Mr. Obama’s official staff, from people familiar with the discussions, comes as the president is seeking to recover public support and credibility after the flawed introduction in October of the insurance marketplaces that are a key part of his signature Affordable Care Act. This week he brought back his former chief congressional lobbyist, Phil Schiliro, who had moved to New Mexico, to help on the health care issues.

Mr. Podesta’s recruitment, by Mr. Obama’s chief of staff, Denis McDonough, also comes as Mr. Obama faces a number of departures by close advisers in the coming months.

Among those exiting is his longtime confidant and troubleshooter Pete Rouse, who has been with Mr. Obama since the future president was elected a senator in 2004. For a few months in late 2010, Mr. Rouse was Mr. Obama’s acting chief of staff.

Mr. Podesta will help Mr. McDonough on matters related to the health care law, administration organization and executive actions, said a person familiar with the plans, and will focus in particular on climate change issues, a personal priority of Mr. Podesta’s.

The White House refused to confirm the recruitment of Mr. Podesta. The person familiar with the matter said Mr. Podesta would not be replacing Mr. Rouse, who is said to have a unique relationship with the president after their years together in the Senate, two presidential campaigns and the White House.

Even so, Mr. Podesta and Mr. Rouse share some similarities. Both are older than the 52-year-old president — Mr. Rouse is 67, Mr. Podesta nearly 65 — and are said to be able to speak candidly to him, much like party elders.

Both also have far more Washington experience than Mr. Obama. Each has spent many years as a senior Senate aide, including postings with Tom Daschle of South Dakota when he was the Senate Democratic leader. Both Mr. Rouse and Mr. Podesta have close relationships with senators, valuable experience going into a midterm election year when the Democrats’ majority in the Senate is threatened.

Mr. Podesta did not respond to requests for comment. It appeared the White House had reached out to him recently.

In mid-November, Mr. Podesta announced that he was establishing the Washington Center for Equitable Growth, a nonpartisan organization within the Center for American Progress, and that he would be its chairman.

The new group will study the growing inequality in incomes and economic opportunity, and promote policies to close a gap that has worsened to levels last seen in the 1920s. Inequality has long been a focus of Mr. Obama’s and has figured prominently in his speeches since he was a state senator in Illinois. Last week, he spoke at a community complex in a struggling Washington neighborhood, where he called inequality and declining upward mobility “the defining issue of our time.”

His host for the event was the Center for American Progress, and Mr. Podesta attended.

Mr. Podesta, who was Mr. Clinton’s chief of staff during the Monica Lewinsky scandal and the impeachment of Mr. Clinton, also has been at the center of foreign policy and national security debates. In 2009, he accompanied Mr. Clinton to North Korea for negotiations that won the release of two American journalists who had been jailed on spy charges.

On Nov. 16, 2010, just days after voters gave Republicans control of the House of Representatives, the progressive think tank Center for American Progress published a report titled "The Power of the President."

Obama-Biden Transition Project Chairman John Podesta introduced the report, writing that "in the aftermath of this month's midterm congressional elections, pundits and politicians across the ideological spectrum are focusing on how difficult it will be for President Barack Obama to advance his policy priorities through Congress."

"Some debate whether the administration should tack to the center and compromise with the new House leadership," Podesta continued.

"As a former White House chief of staff, I believe those to be the wrong preoccupations. President Obama's ability to govern the country as chief executive presents an opportunity to demonstrate strength, resolve, and a capacity to get things done," Podesta said.

Not only did Obama almost immediately embrace the report's call for maximizing executive power to achieve progressive ends without Congress, it even branded the effort "We Can't Wait," thus advertising the fact that Obama had abandoned all pretense of following the U.S. Constitution's carefully drawn separation-of-powers doctrine.

Instead of taking his case to the American people in an election year, Obama abandoned the democratic process entirely by unilaterally rewriting American immigration policy.

On June 15, 2012, Obama announced his Deferred Action for Childhood Arrivals policy. Illegal immigrants who came to the United States before they were 16, were younger than 31, had been in the United States for at least 5 years, were either in school or had graduated high school, and had not committed “significant” crimes, would be given “deferred action” status.

Sometimes also called “non-priority enforcement status,” immigrants granted such relief are not citizens, or even legal permanent residents. But they can obtain a work permit, get a Social Security number, and apply for a driver’s license. The status is temporary, however, and must be renewed every two years.

Presidents have exercised prosecutorial discretion in immigration enforcement since the founding of the country. Some immigrants are favored over others for foreign policy reasons, other immigrants are targeted for their political beliefs, and still others are granted relief for humanitarian reasons.

But these acts of discretion were always done on an ad hoc, case-by-case basis. They were not a wholesale rewrite of immigration policy, let alone one that had been specifically rejected by Congress.

Never before in the history of the United States had an American president rewritten immigration policy by administrative fiat. The tactic is so new, and so audacious, that there is simply no body of case law available to establish that the scope of Obama’s administrative amnesty plan is illegal.

And the scope of Obama’s administrative amnesty is still growing. On Aug. 23, the Immigration and Customs Enforcement agency issued a memo directing all ICE personnel to exercise “prosecutorial discretion” in favor of any illegal immigrant who claimed they were a parent or guardian of any minor currently in the U.S.

The memo does not direct ICE agents to grant these immigrants formal “deferred action” status, but it does make it highly unlikely any of them will ever be deported.

Since it is unlikely any individual U.S. citizen could establish standing in federal court to challenge any of these actions, nothing is stopping Obama from administratively granting amnesty to every illegal immigrant in the country today, and those that enter as long as he remains president.

Of course the real joke is on all of us since "ThinkProgress" (SOROS/Podesta) claims to be “independent journalism.”

The illegal actions of the Obama administration leaves Congress with only a few options.

(1) Impeachment: highly unlikely no matter what he has done.

(2) Appeal to the Courts: they haven't done so thus far and I am not even sure what grounds they would sue, nor if they have "standing". But then, who does in these situations?

(3) Cut off his funding: this they can do but that, of course, would lead to another government shut down and the Republicans would take the hit, even if they were doing so in order to protect the Constitution and the rule of law.

Anyone else have any ideas? It would appear we have a a third rate dictator as President and no one can stop him. Once again, events show character means a lot when it comes to our leaders.

He's flaunting the law and the Constitution because he can. We have a Constitutional requirement the president is a natural born system - but no checks and balances to make it so.   

Obama is breaking the law by rewriting Obamacare - but congress is neutered as far as stopping him because the person suing to stop him has to have "standing" and I guess going against the law and usurping congress doesn't actually GIVE congress standing to legally stop him.  I guess up til now the presidents have obeyed they law because it was the right thing to do, but most have been pushing the envelope a little further than the last to see how far they can go and this president is all in... I knew in 2008 he was going to move for a total takeover and it looks more and more like this is exactly what is happening and in the meantime  8888crybaby Boehner is pushing forward with immigration reform when all effort SHOULD be on stopping this takeover of our country.
