Supreme Court Refuses to Block Texas Abortion Restrictions

DEVELOPING: The U.S. Supreme Court has declined to block controversial Texas abortion restrictions that have been called some of the strictest in the country.

The court by a 5-4 vote denied a request by Planned Parenthood to block a ruling by the Fifth Circuit Court of Appeals, which allows key parts of the Texas abortion law to stay in effect while the case plays out.

The ruling means that a provision will remain in effect requiring abortion doctors to have admitting privileges to a hospital within a certain geographic location. Planned Parenthood is arguing this provision makes it difficult for Texas women to obtain an abortion.

Justice Antonin Scalia, writing in support of the high court order Tuesday, said the clinics could not overcome a heavy legal burden against overruling the appeals court. The justices may not do so "unless that court clearly and demonstrably erred," Scalia said in an opinion that was joined by Justices Samuel Alito and Clarence Thomas.

Chief Justice John Roberts and Justice Anthony Kennedy did not write separately or join any opinion Tuesday, but because it takes five votes to overturn the appellate ruling, it is clear that they voted with their conservative colleagues.
