Berry should be haunted by the death of this dog for the rest of his miserable life.  He WAS negligent.  No doubt he went in and had a beer or two and forgot his partner, or simply never felt very close to the dog in the first place.

If he's not guilty of criminal negligence, he should be fired.  My dogs are always on my mind when I have them in the car.  There is no way I would forget a dog or a kid in a car.

Those that do are either dense or criminally negligent.

I see too much of this here in the summer, people WILL break windows in my town to rescue a dog they see in a car in a parking lot somewhere around town and the police will arrest anyone who leave a dog unattended in the heat.
