Let's hope that the Senate can hold off the pressure.  I am expecting that there will be tremendous pressure to allow the current occupant to name his replacement.

Fortunately the Republicans control the Senate agenda, and they must hold off this nomination.  This is a far more momentous issue than the presidential election as it would turn the Court around to a liberal majority.

One of the bulwarks is gone.

This goes to show how important this election will be.   The Senate will delay any replacement until the new President is known.

Folks,  I hate to sound like a broken record,  but this terrible loss should focus minds about what's really important, and what must be done.  Trump cannot be the nominee.   The time for games and vanity is over.  This election must be won. 

R.I.P.  Justice Scalia.

I'm sure the liberals are celebrating, their only sadness being that they can't put a few million more conservatives in the grave, ASAP.

Given the timing and cases on the docket, I do hope this is natural causes. Although he wasn't a spring chicken, I am always suspicious of fortuitously timed events like this. Alot of important cases on the docket that the liberals need to go their way this year.

Watch Obama try to ramrod a new radical left appointment in there as quickly as possible.

Can Congress delay the appointment for over a year?  I don't mean to say whether they'd want to or not, but don't Supreme Court justices have to be replaced with some level of speed?

If it's delayed until a Senate recess, then Obama would be able to appoint anyone to the vacancy (at least, until the end of the next Senate).

They have given him everything else he has wanted. AG Lynch is a example. That other real hard core lefty fed judge just a few weeks ago too.

NBC chief legal analyst Pete Williams reacts to the death of Supreme Court Justice Antonin Scalia, aged 79, on Saturday. Williams says he would be "very surprised" if the vacancy would be filled before the next Supreme Court term starts in October.

"I would be very surprised, frankly, if a vacancy can be filled in time for the next term to start when it starts in October, but it's such an unexpected thing, such a sudden thing, it's such a shock, and that's the way these things tend to go," Williams said.

Williams' full commentary below, aired on MSNBC:

    PETE WILLIAMS, NBC'S CHIEF LEGAL ANALYST: The president will have to pick a nominee, President Obama, and the question here is whether the Senate will even consider a nominee under these circumstances in the middle of an election year. Normally when Supreme Court Justices think about retiring, because of ill health or whatever considerations, they don't historically do it in an election year if they can all avoid it because they don't want the nomination of their replacement to be a political football.

    When something like this happens there is no choice but it is a very difficult time and it's certainly going to be something that the Senate is going to have to think about, whether they're going to leave the Supreme Court with just eight Justices and wait until the presidential election to see if a Republican gets elected and will appoint the next nominee or go ahead and fill this vacancy.

    I would be very surprised, frankly, if a vacancy can be filled in time for the next term to start when it starts in October, but it's such an unexpected thing, such a sudden thing, it's such a shock, and that's the way these things tend to go.

The Court can operate with only eight Justices.  The number of SC Justices is established by Congress via statute.  It has varied in the past.

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

Chief U.S. District Judge Orlando Garcia, of the Western Judicial District of Texas, was notified about the death from the U.S. Marshals Service.   

U.S. District Judge Fred Biery said he was among those notified about Scalia's death.

"I was told it was this morning," Biery said of Scalia's death. "It happened on a ranch out near Marfa. As far as the details, I think it's pretty vague right now as to how," he said. "My reaction is it's very unfortunate. It's unfortunate with any death, and politically in the presidential cycle we're in, my educated guess is nothing will happen before the next president is elected."

The U.S. Marshal Service, the Presidio County sheriff and the FBI were involved in the investigation.

Officials with the law enforcement agencies declined to comment.

A federal official who asked not to be named said there was no evidence of foul play and it appeared that Scalia died of natural causes.

A gray Cadillac hearse pulled into the ranch Saturday afternoon and left about 5 p.m. The hearse came from Alpine Memorial Funeral Home.

Texas Gov. Greg Abbott released a statement Saturday afternoon, calling Scalia a man of God, a patriot and an "unwavering defender of the written Constitution."

"He was the solid rock who turned away so many attempts to depart from and distort the Constitution," Abbott said. "We mourn his passing, and we pray that his successor on the Supreme Court will take his place as a champion for the written Constitution and the Rule of Law. Cecilia and I extend our deepest condolences to his family, and we will keep them in our thoughts and prayers."

Scalia was nominated to the U.S. Supreme Court in 1986 by President Ronald Reagan.

The death of Supreme Court Justice Antonin Scalia creates a rare opportunity for President Obama to appoint a new justice for a lifetime term,  but winning confirmation by the Republican-controlled Senate in an election year would be nearly impossible.

Senate Majority Leader Mitch McConnell, R-Ky., indicated the Senate will not move on an Obama nomination.

"The American people‎ should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new President," he said in a statement.

Shortly after Scalia's death was confirmed, the communications director for Sen. Mike Lee of Utah, a member of the Judiciary Committee, signaled the battle ahead.

Conn Carroll posted on Twitter: "What is less than zero? The chances of Obama successfully appointing a Supreme Court Justice to replace Scalia."

The opening undoubtedly will fuel at debate in the presidential campaign about the importance of choosing his successor on a closely divided court.

The death was first reported by the San Antonio Express News on its website, quoting U.S. District Judge Fred Biery.

"It's unfortunate with any death, and politically in the presidential cycle we're in, my educated guess is nothing will happen until the next president is elected," Biery told the newspaper.

Sen. Patrick Leahy of Vermont, the top ranking Democrat on the Senate Judiciary Committee said there is no reason a new justice should not be confirmed.

"I hope that no one will use this sad news to suggest that the President or the Senate should not perform its constitutional duty," Leahy said. "The American people deserve to have a fully functioning Supreme Court. The Supreme Court of the United States is too important to our democracy for it to be understaffed for partisan reasons. It is only February. The President and the Senate should get to work without delay to nominate, consider and confirm the next justice to serve on the Supreme Court.”

Most lawmakers stuck to statements of tribute to Scalia's contributions to the nation, but some cast ahead to the political battle likely to follow.

Rep. Chris Stewart, R-Utah, tweeted "senate must not allow this Pres to seat his replacement."

This is a very high probability scenario:

--There will be heavy pressure on the GOP to consider an appointment before the Nov. 2016 elections, but assuming the GOP holds out

--The Senate majority will be won by the democrats in Nov. 2016 (75%)

--The democrats will win the Presidency in Nov. 2016 (60%)

--Compounding those probabilities the GOP stands a 10% chance of blocking a democrat appointee by both holding the Senate and winning the Presidency (0.40*0.25)

FOX also said it is unlikely that anyone nominated will be affirmed, and that task will most likely fall on the next President. So it's not time to panic.   Not to be crude, and my deepest condolences to the Scalia family, but the timing may actually be good for this election cycle.  Having us focus deeper on a candidate's conservative history and what they will actually do after they take the oath of office,  and not just stump speech promises.

I think it lasts until the next Senate session approves the appointment... or till the end of the next Senate session, if not. 

The only way to stop it is if the Senate does not go into recess.  Being an election year, I don't hold any hope that the Senate will stay in session for 11 months.  That would prevent the Senators from running their re-election campaigns.

This goes to show how important this election will be.   The Senate will delay any replacement until the new President is known.

Folks,  I hate to sound like a broken record,  but this terrible loss should focus minds about what's really important, and what must be done.  Trump cannot be the nominee.   The time for games and vanity is over.  This election must be won.

Yes. If someone is nominated and approved, then the recessed-appointed Justice has to step down.
If nobody is appointed (by, say, a Hillary), the recessed justice gets to stay on the court until the end of the Congressional term, which is January of 2019

Like most of you, I'm learning on the fly how these appointments work, but let me inject some facts in this discussion, - some pros and cons:

•Supreme Court appointments are rarely actually rejected. The last was Reagan's appointment of Robert Bork in 1987, which was rejected by a Democratic Senate in Reagan's last year of office, so a similar, but reversed situation to what we have now. Reagan's second appointee was forced to withdraw because of a scandal and finally Justice Kennedy was approved unanimously.

•Even lame duck presidents eventually get a nominee in, even if it is not their first nominee.

•An exception can be the so-called "Thurmond Rule" which according to Wikipedia "is an informal and somewhat amorphous rule in the United States Senate regarding confirmations of judicial nominees. The rule has been described as being that "no lifetime judicial appointments would move in the last six months or so of a lame-duck presidency." This is not really a rule, it is more like a political reality.

•The record for longest time period to go through the process is 125 days, although this one could set a new record. Obama has about 342 remaining in office. I think our best hope is that Obama nominates someone they can find grounds to reject and they take their time doing it. Then the next nominee starts pretty close to that six month window. Then they could drag their feet until the clock runs out and not actually have to reject the second nominee.

•More bad news: Obama could appoint a nominee during Senate recess and they have three big ones coming up: Summer, Fall and Winter. That appointment would only last for two years, though, not a lifetime. However, a Democratic Senate blocked Bush from making recess appointments using "pro forma" sessions, where one Senator stays behind on recess, opens the Senate each day to an empty chamber and they closes it ten minutes later. From what I have heard he had been quail hunting in west Texas yesterday and told his hunting companions he was not feeling well yesterday evening and passed in his sleep. He was discovered this morning when he did not show up at breakfast.

Not in Obama's view it isn't...nor his partisans.  I would not be too certain about what American voters understand, that depends entirely on where their interests and loyalties lie.  He may appoint and raise the pressure to a very high intensity...then recess appoint.  This is for the Democrats the Golden Calf of all Golden Calfs, they will not let this go without The Mother of All Battles, there will be scorched earth.

Senate Majority Leader Mitch McConnell said Saturday that the “American people‎ should have a voice in the selection of their next Supreme Court Justice. “Therefore,” he said in a statement, “this vacancy should not be filled until we have a new President.”

McConnell’s statement was met with a fiery retort from Senate Minority Leader Harry Reid, who said leaving a seat on the Supreme Court vacant for a year until Obama’s successor takes office would be “unprecedented.”

“Failing to fill this vacancy would be a shameful abdication of one of the Senate’s most essential Constitutional responsibilities,” Reid said.

Scalia’s death came at a volatile time in American politics and as TIME’s Jay Newton Small writes, could upend both the Republican party and the Court. “Currently the court swings 5-4 conservative. But if President Obama manages to confirm a liberal to the bench, it will swing the court 5-4 the other way,” Jay writes. “This could have profound and reaching implications on everything from abortion and women’s rights to campaign finance and Second Amendment rights.”

President Obama has successfully appointed two justices during his two terms in office, including Justice Sonia Sotomayor in 2009 and Justice Elena Kagan in 2010. Though Obama said Saturday he would fulfill his presidential duty of appointing another justice given the seat left vacant by Scalia, the road ahead will be bumpy.

Obama did not say who he would be nominating in the coming months, but whoever he taps will likely face significant opposition from Republican lawmakers.

Remember, Mitch McConnell wants to see government work and that filibusters and procedural blocks are beneath the office of the Senate. I have no doubt he will eventually cave on some "compromise" candidate who is probably on the same level as Sonia Sotomayor—who has turned out to be a reliable pro-Obama vote.

This could be the turning point of our country's history. One needs only to look at the Warren Court to see the kind of carnage and destruction a runaway liberal court can cause.

Not quite. You had three conservatives (Scalia, Thomas and Alito), two swing votes (Roberts, Kennedy) and four liberals (Sotomayor, Kagan, Breyer and Ginsburg). The court was in a delicate balance ever since the early 1990s, one that is dangerously close to being upset.

It is most likely, that the next President will be the one confirming Scalia's replacement. We are about to find out that the biggest issue of this election is not immigration, or the great great Wall somebody is promising, or  how best to defeat ISIS or keep jobs in America and Taxes low. But How to retain a 5/4 SCOTUS, and assure a 6/3 if another appointment opens up.     Trump saying his pro-abortion sister would make a great Supreme Court Judge, could come back to haunt him beginning at tonight's debate.

If I were a ruthless, big game political operative/strategist with no morality, wanting to win at all cost, it's what I'd do. It's almost grandiose to say it, but the fate of the nation hinges on one more liberal joining SCOTUS. It's the liberals holy grail, what would they do to make it happen?

Truly a very sad time for our nation.  Sorry, but I see foul play on this one ... agreed the timing is very convenient. Hussein's executive orders; 2nd amendment and amnesty are currently before SCOTUS for ruling.  I see it that Hussein will push for a quick replacement for Scalia with a liberal and the RINO's in the Senate will gladly oblige.  Then he will push for an immediate ruling on his executive orders. The new liberal SCOTUS will rule in Hussein's favor; amnesty insures the DEM vote!!  They will rule in favor of Hussein's executive order on the 2nd amendment.

With Trump leading in the polls and Cruz in second -- the DEMS knew that the writing was on the wall.  They knew that if Cruz got in, not only would he shake up Washington but he would place the most conservative justices that he could and the liberal progressive agenda would end. Trump has taken conservative viewpoints, and I think they see him as a threat as well.  RIP Justice Scalia!

We have no way of knowing for sure and the level of technology available today for that sort of thing makes it very likely that NO ONE will ever know for sure.
It certainly looks suspicious. A sudden illness, falling asleep and dying looks A LOT like someone poisoned him.

It sounds like a heart attack to me.  Happens frequently that way: fairly sudden onset of nausea and fatigue, go lay down to rest, and never get up.

Just the other day, I said that these Conservative judges need to get tasters...or stay the hell out of public...commit themselves to 'House Arrest'.

I understand this happens to people 79 years of age.  Everyday.  But...the timing here is devastating and can't help but wonder.....

Everything seems so logical to me and yet nobody else seems to see it.

I think the timing of Scalia's death benefits conservatives.  With a SCOTUS nomination hanging in the balance the election will have much more urgency to conservatives interested in preserving our constitutional rights.  OTOH God only knows who Trump might nominate for the job.

I agree.   If anything can unite us over the necessity to WIN this fall's election, it is this.

I did not have a choice and dad died from cancer, which he had been treated for over 18 months.


Maybe things have changed and even if so, I do not believe for a single second they family said no!

Not sure what Texas law is, but if the family thought there was any chance of foul play I would think they would insist on an autopsy.  I suspect even if there was an autopsy, the blogosphere would be rife with suggestions as to how to murder someone and get past an autopsy.

The issue now of course is what the Democrats and Republicans will do between now and January 20.  A murder or natural causes won't change that.

In theory, I would WANT an even number of seats. It'd make them more eager to work out a solution if there were a risk of a tie.

In practice, Roberts or Kennedy would be the first to flip to the other side as it's currently configured.

Please answer the questions.  Do you really think a Constitutional amendment will garner the number of votes needed?

And why is it a good idea? Jmyrlefuller had a good argument, but I do think it's necessary to have an odd number of judges to settle ties.  The Appeals courts use 3 judge panels for that reason.

There is no need for a Constitutional Amendment to alter the number of Supreme Court Justices.  As established in Article III Section 1, Congress is given the authority to set the number of Justices via statute.  It was last altered when it was set to nine via statute in 1869.

No, I don't expect the Republican held senate to do Anything except approve Everything the Kenyan wants approved!
