GOP senators introduce bill to rein in president's emergency powers

More than a dozen Republican senators introduced legislation on Tuesday that would make it easier for Congress to terminate future national emergency declarations, days before the chamber will vote on President Trump's.
 
The legislation, spearheaded by Sen. Mike Lee (R-Utah), would require that Congress pass a resolution extending an emergency declaration after 30 days for it to continue, otherwise it would be terminated.
 
“If Congress is troubled by recent emergency declarations made pursuant to the National Emergencies Act, they only have themselves to blame. Congress gave these legislative powers away in 1976 and it is far past time that we as an institution took them back. If we don’t want our president acting like a king we need to start taking back the legislative powers that allow him to do so," Lee said in a statement.
 
In addition to Lee, GOP Sens.  Chuck Grassley (Iowa), Thom Tillis (N.C.), Joni Ernst (Iowa), Pat Toomey (Pa.), Ron Johnson (Wis.), Jerry Moran (Kansas), Lamar Alexander (R-Tenn.), Ben Sasse (Neb.), Roy Blunt (Mo.), Rob Portman (Ohio), Todd Young (Ind.), Mitt Romney (Utah), Ted Cruz (Texas) and Roger Wicker (Miss.) are supporting the legislation.

McConnell opens door to changing president's emergency powers

Senate Majority Leader Mitch McConnell (R-Ky.) signaled on Tuesday that he is open to changing the president's national emergency powers as support grows within the GOP caucus for amending the National Emergencies Act.

"We're looking at some ways to revisit the law. There's a lot of discomfort with the law. ... Was it too broad back in the '70s when it was passed? So yeah, we're discussing altering that," McConnell told reporters during a weekly press conference.

A growing number of Republican senators have expressed interest in amending the National Emergencies Act to make it easier for Congress to terminate a national emergency.

The discussion is focused on future national emergencies but comes days before the Senate will vote on a House-passed resolution of disapproval blocking Trump's emergency declaration at the border.

Congresses prerogative, but they need to discipline themselves too.  When was the last time they actually passed an appropriations bill?  CRs are what got us into the mess.

Even if this passes Congress it should not impact the State of Emergency on the table.   It will affect states of emergency going forward which should reduce the "fear" the democrats will use this for gun control, etc. and the fear the Executive will usurp the power of the purse going forward.   

The Republicans will stand in a bubble of their own creation and decide if protecting American citizens is worth this one, unique State of Emergency.

IMHO, I don't think that they are so worried about reining Trump in as they are in preventing the looney left mental midgets from overreaching emergency powers in the future.

The GOP greatly fears the left.  They wasted their majority and once again FAILED to push the DEMS back.  Interesting that technically the GOP had the majority, but the DEMS have remained in power.

If they want this pull back on authority the Rats gave the POTUS back in 1976 they better draft something that is agreeable to Trump, or has a veto proof majority. No President should just give away any of their legal authority.

What's not being discussed is how meaningless all this is when a Rat is POTUS. obama just made up programs with "executive authority". DACA is being treated like it's bedrock law and it was just created out of nothing. Congress had no will to do anything then. Now we have a POTUS who makes sure he has the legal authority to do something and Congress gets all worked up, including some of his own party.
