Could the driver climb in the back seat without engaging the Autopilot?  Only on cruise control?

Drunk and stupid allows for a lot of senarios.

Tesla said AP was not engaged. They know. They have a system in place that captures lots of telemetry, including camera footage, anytime there is a crash.

The question is one of whether the driver or passenger died on impact, or had moved before or after the fire started, perhaps trying to get out of the other door.

Seventeen Techniques for Truth Suppression

Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.

The process known as "natural selection" at work.
