D.C. Circuit judges seem disturbed by the degree to which Judge Sullivan has exhibited bias in Flynn’s case.

Maybe Judge Luttig was right all along.

I had the misgivings you’d expect back in late May, when I disagreed with J. Michael Luttig, the stellar scholar and former federal appeals court judge, regarding how the D.C. Circuit Court of Appeals should handle the Flynn case.

At the time, that court’s three-judge panel had not yet heard oral argument on Michael Flynn’s mandamus petition — i.e., Flynn’s request that the panel find that federal district judge Emmet Sullivan was acting lawlessly. Sullivan had not only failed to grant the Justice Department’s motion to dismiss the criminal case against Flynn; he had appointed a former federal judge (the overtly anti-Trump John Gleeson) to posit the argument abandoned by DOJ — to wit, that Flynn should proceed to sentencing because he had pled guilty to a false-statements charge, waiving his right to contest the case any further in exchange for the government’s agreement not to file any other charges. Basically, Flynn was asking the appellate court to order Judge Sullivan to dismiss the case.

In a Washington Post op-ed, Luttig contended that “there are ample grounds in the actions the district court has already taken for the appeals court to order that the government’s motion to dismiss be heard by a different judge, and it should so order.”

Sullivan is a political hack with an axe to grind on behalf of the Obama administration.  He is a disgrace to the very concept of justice in America... which, come to think of it, has become quite an unfunny joke since the Obamanation.   Another predictable end result of Leftism run amuck.

McCarthy makes the point that something has indeed changed since May:  Sullivan appealed to an en banc hearing, and only a party to a case can do that.  No Circuit Judge made the request, forcing Sullivan to do it all on his lonesome.  In making the Appeal, Sullivan converted his role from arbiter to prosecutor.

Now they are likely to throw Sullivan off the case, and order the new Judge to dismiss the case, as they did in the 3-Judge ruling.  If the Republicans retake the House in November, Sullivan may be impeached.  That would be cool.

Talking about what "should be" done ..... vs. what is (or rather, isn't) being done when it comes to serving justice in America to the leftist cretins that have damaged our Justice System beyond belief...

seems a bit naive.

Which is 'why' we needed to see some justice doled out via the "Durham Investigation" already.  Instead, it's more of that "wait just a little longer" .... a few more months....it's coming....BS.  Pardon my skepticism... but I don't see ANY justice handed out re: Sullivan if none comes to the ones pulling Sullivan's strings.
