Monday night, Mark McCloskey appeared on Tucker Carlson’s show and hinted that “revelations” about his case would soon come out. He and his wife, Patricia, face felony charges for using firearms — without firing a shot — to defend their home from protesters in St. Louis in late June. Missouri has a broad Castle Doctrine, but Circuit Attorney Kim Gardner has ignored that in announcing Class D felony charges against them.

Earlier on Monday, I took a look at the case against them and was surprised to learn that both of their guns were likely not capable of being fired at the time of the incident. Mrs. McCloskey’s handgun was described as a “prop” they had used in a trial (they’re both attorneys). Mr. McCloskey’s rifle was reportedly not loaded during the confrontation and there was no ammunition found in their home.

Now, our sister site RedState reports that the revelations Mr. McCloskey hinted at have come out.

In Missouri, police and prosecutors must prove that a weapon is “readily” capable of lethal use when it used in the type of crime with which the McCloskeys have been charged.

At the request of Assistant Circuit Attorney Chris Hinckley, crime lab staff members field stripped the handgun and found it had been assembled incorrectly. Specifically, the firing pin spring was put in front of the firing pin, which was backward, and made the gun incapable of firing, according to the documents.

Firearms experts then put the gun back together, per Hinckley’s request, in the correct order and test-fired it, finding that it worked, according to the documents.

Framing? Yeah, if the wife's gun would have been described as other than inoperable. OTOH, if it were not accurately described - something that could be learned now if her office's notes on the case were to be subpoenaed and examined - Gardner and/or her associates on the case should be prosecuted by the state AG for evidence tampering.

The McCloskeys have been, to some degree, anti-police. I hope that in having to try to unravel the unjust results of their lawfully defense of their persons and property they take a good, hard, look at the snake they've neen embracing, the BLM thugs and their abettors in the DA's office.

According to the McCloskeys, the incorrect assembly of the gun wasn’t an accident. The same gun had been used as a “prop” in a previous lawsuit and the McCloskeys had rendered it inoperable so that it could be brought into a courtroom. In short, the McCloskeys claim they knew the gun was non-functioning when Patricia McCloskey took it outside that day.

Mark McCloskey appeared on Tucker Carlson’s show earlier this week and was asked about his guns being seized. He mentioned the requirement that police show the gun was capable of lethal use and said, “there will be some revelations that come out about that.” He didn’t say at the time what those revelations would be but in retrospect it’s clear he was alluding to the fact that Mrs. McCloskey’s gun was non-functional.

The McCloskeys’ attorney said of prosecutor’s decision to reassemble the gun and then declare it lethal, “It’s disheartening to learn that a law enforcement agency altered evidence in order to prosecute an innocent member of the community.” ...

LOUIS — The gun Patricia McCloskey waved at protesters was inoperable when it arrived at the St. Louis police crime lab, but a member of Circuit Attorney Kim Gardner's staff ordered crime lab experts to disassemble and reassemble it and wrote that it was “readily capable of lethal use” in charging documents filed Monday, 5 On Your Side has learned.

That's Evidence Tampering, and they're hiding behind the "Standard Procedure," which is to do whatever repairs are necessary to fire the gun for ballistics purposes.  The "Standard Procedure" is bad policy, because it changed the nature of the evidence sufficiently to change the outcome of a decision to charge a defendant.  This cannot be allowed to stand!
