The Texas Education Agency’s plan to strip power from elected Houston ISD school board members has been halted, likely for several months, after a Travis County judge Wednesday evening issued a temporary injunction against the state.

In a five-page order, Travis County District Judge Catherine Mauzy ruled that HISD trustees met their burden for showing “probable right of recovery” on legal claims that Texas Education Commissioner Mike Morath does not have the legal authority to oust board members. Morath announced plans to temporarily replace the board in November, citing a state law requiring sanctions after Wheatley High School received its seventh consecutive failing grade, as well as multiple substantiated findings of misconduct by current trustees.

Mauzy ordered that Morath cannot oust board members until the district’s lawsuit seeking to stop their removal is resolved or another court order is issued. She set a trial date for June 22.
