Pittsburgh gun ordinances struck down by Allegheny County judge

Quote
Judge Joseph James agreed with attorneys for gun rights advocates that the Pennsylvania Uniform Firearms Act trumps the city's ability to pass such legislation at a local level.

"Stated simply, under the doctrine of field preemption, the UFA preempts any local regulation pertaining to the regulation of firearms," James wrote. "The Uniform Firearms Act is a comprehensive statute that evidences an intent by the Legislature to preempt the entire field of firearms and ammunition across the state of Pennsylvania."

And apparently still does.  I understand the city is going to appeal.   *****rollingeyes*****

They're mostly Democrats and a significant percentage of them don't pay taxes, so what do they care?  As long as someone else is paying the legal bills (they think), they want the City to take this to SCOTUS, if necessary.

Pittsburgh Mayor Peduto and Allegheny Co Chief Executive Officer Fitzgerald Disgustingly Conspiring to Unseat Judge James for Pittsburgh Decision
Posted on October 31, 2019
 by Joshua Prince, Esq.

I was just informed that Pittsburgh Mayor Bill Peduto and Allegheny County Chief Executive Rich Fitzgerald are conspiring to unseat Allegheny County Court of Common Pleas Judge Joseph M. James because of his decision this week ruling – consistent with Article 1, Section 21 of the Pennsylvania Constitution and the binding precedent – that the City of Pittsburgh’s firearm ordinances were unlawful.

Apparently, Mayor Peduto and Chief Executive Fitzgerald will be filing a frivolous ethics complaint and taking other action against Judge James, in a disgusting attempt to unseat him, for upholding the Pennsylvania Constitution and binding precedent, even after Mayor Peduto, on December 14, 2018, acknowledged publicly that the City of Pittsburgh lacked the legal authority to enact Ordinances 2018-1218, 2018-1219, and 2018-1220. ...  More

Not liking a judge's ruling does not constitute grounds for an ethics complaint.   The judge ruled according to the law.   Where is the ethics violation, Patootey?

@mountaineer

As an aside, I notice the idiot mayor's beard is getting longer and fuller.  I'm going to start calling him "Bad Santa."   happy77

I have long believed that disagreeing with a liberal does make you a racist, it generally means you are correct. I think I may have to modify that to include disagreeing with liberals disagreeing with the rulings of Conservative judges.

Exactly. When I posted that article, I was going to comment on what a fascist Peduto is. Obviously, observant people can draw their own conclusions!
