Sen. Ted Cruz will oppose President Donald Trump’s nominee for the 5th Circuit Court of Appeals, Halil Suleyman “Sul” Ozerden, a major setback for the embattled nomination.

Cruz (R-Texas) has informed the White House and colleagues this week that he will oppose Ozerden, according to three people familiar with the Judiciary Committee’s internal dynamics. That conservative opposition places in doubt the future of Ozerden, who is a close friend of acting White House chief of staff Mick Mulvaney, and whose nomination Mulvaney pushed over the objections of the White House Counsel's office. 

“For a lifetime appointment on the court of appeals, I believe we should be looking for someone with a strong, demonstrated record as a constitutionalist. I have significant concerns that Judge Ozerden’s judicial record does not indicate that he meets that standard. For that reason, I do not believe he should be on the court of appeals, and I will oppose his nomination," Cruz said in a statement for this story.

Some of the misgivings about Ozerden are not grounded in ideology or judicial philosophy, but mere judicial competence.  Ozerden has an unusually high reversal rate:  of his 59 decisions that have been reviewed by the Fifth Circuit, 25% have been overturned.  While a reversal rate on its own isn’t necessarily conclusive evidence of poor judicial decision-making or a lack of competence, remember that we are talking about the Fifth Circuit here, not the Ninth Circuit.  Ozerden has been reversed by some of the most conservative judges in the country, including Edith Jones and Jerry Smith.  And a number of those reversals from three-judge panels have been unanimous.

I concur.  And he is a friend of Mulvaney.  I am not impressed with him either.   Mulvaney was the failure in government shut down.  He wanted to negotiate down any chance of wall.

Other undecided senators are digging into the nomination. Sen. Josh Hawley (R-Mo.) met with Ozerden on Thursday morning and Sen. John Kennedy (R-La.) said he was undecided on the nomination. But the Mississippi judge got a boost Thursday from Sen. Mike Lee (R-Utah) who decided to vote for his nomination after meeting with Ozerden, according to Lee's spokesperson.

A person qualified to be a federal judge should be able to handle any pressure. If they can't, they shouldn't be a federal judge.

"Political pressure" is a backyard squirrel.   The judges themselves are activists with their inner biases.

And when that lifetime appointment rule was written and passed, America's schools and universities weren't teaching Social Marxism.

We're at the point where that argument/concept have been proven FALSE.

And Senator Cruz helps himself here in his audition for the SCOTUS.  Pres. Trump's base wants a strict Constitutionalist, especially, with Gorsuch and/or Kavanaugh sitting just right of center, IMO.   

It's good to see him getting involved in cases where Constitutionalists should be mandatory (lifetime appointments)

I go with Cruz here as well. There's no political reason for him to oppose this nomination at this time. These appointments are too crucial and I no longer trust Mike Lee.

I hope this nominee is stopped, I'm also like Cruz in supporting the president in 2016 and supporting  Trump on most of his agenda.  That's called consistency. That's not called hypocrisy.

Mike Lee has certainly gone to the dark side with Romney. I guess the Mormons stick together, given Romney's consulting Harry Reid even after Reid smeared him.

As a district judge, Ozerden approved the Obama administration’s dismissal of a challenge to the Affordable Care Act’s contraception coverage mandate, deeming the challenge premature. Senate Republicans have expressed concern about Ozerden’s decision in 2012.
