The Pennsylvania Supreme Court refused Wednesday to overturn a $1.8 million fine slapped on an energy company for gouging customers for electricity as a polar vortex held the state in its icy grip.

With two justices dissenting, the high court rejected HIKO Energy LLC’s claims that it was unfairly punished by the Public Utility Commission for contesting the charges lodged against it rather than settling the case.

The PUC didn’t abuse is power in fining HIKO, Justice Sallie Updyke Mundy wrote in the court’s majority opinion, and there is no evidence the agency hit HIKO with the unusually large financial penalty because it chose to fight.
