Prosecutors connect Trump to illegal payments during the campaign

For the first time, federal prosecutors in New York on Friday said that President Trump directed his former lawyer Michael Cohen to make two illegal payments during the 2016 presidential campaign.

Prosecutors in the U.S. Attorney's Office for the Southern District of New York connected Trump to the illegal payments in the latest filing in the case involving his longtime lawyer and fixer.

The document states that Cohen "acted in coordination with and at the direction of" Trump before the election in steering payments to silence Stormy Daniels and Karen McDougal, two women claiming they had affairs with Trump in 2006. Trump has denied the affairs.

The latest filing does not explicitly name Trump, but makes numerous references to an "Individual-1" who it states in January 2017 "had become the President of the United States" and for whom Cohen worked as a personal attorney.

Prosecutors argue that Cohen made the payments for the rights to Daniels and McDougal's stories before the election in order to "suppress the stories and thereby prevent them from influencing the election."

I missed the illegal part


That was back in August, when Cohen entered his guilty plea to the campaign finance violations. At least one of those charges is connected to the Daniels civil suit. At some point, Trump will have to go on the record, under oath in a deposition to either deny Cohen’s allegations or plead the 5th.

Somehow, I think you’ll feel better about it, when Tony Podesta and Greg Craig are facing charges. When they are, remember where that referral originated.

Really?  So.... since he has nothing 'else' (certainly not anything even remotely connected to ""collusion with Russia" evidence).... Mueller is now going to attempt to claim that Trump committed campaign violations by paying off two bimbos?   Ahmazing.  This is going to be a circus deluxe worthy of only the best popcorn.  I hope that... when it is all over... Mueller is later relegated to the smallest clown-car on the planet....for the rest of his life.

NDAs aren't illegal, nothing links Trump to Daniel's, I can't think of any way they can determine where the 130k ultimately came from. This is about optics, not the law.

But we already knew that.

But we already knew that.

Right.  And we knew a year ago that even if Trump paid off Daniel that it wasn't illegal OR couldn't be construed as a campaign finance violation.  Yet.... a year later... here we are reading this leakage from the Mueller hit squad.  Mueller is just setting the stage for the rats impeachment proceedings next year.  It's going to be a really long and gaggy next two years, I'm afraid.

The entire point of the Cohen plea is that this was more than a NDA. Cohen links Trump to Daniels, according to his plea. They're not going to simply take his word for it, given they knew he had previously made false statements. They likely do know where the money came from, since SDNY gave David Pecker and Trump Org CFO Allen Weisselberg immunity.

When he fails to put it on his disclosure, which is exactly what he did.

A separate but related question is whether the payment to Daniels, coming just a few days before the 2016 election, was related to Trump's run for the White House. That would make it a campaign expense — an illegal one because it wasn't made with campaign contributions or disclosed on campaign financial reports.
