Mueller recommends no jail time for Flynn, citing his 'substantial assistance'

Special counsel Robert Mueller on Tuesday asked a federal court for no prison time for national security adviser Michael Flynn, citing his “substantial assistance” in the investigation into possible collusion between the Trump campaign and Moscow.

In a court filing late Tuesday, Mueller said it would be “appropriate” for the judge to impose a sentence for Flynn that does not include prison time. Federal sentencing guidelines called for Flynn to be sentenced to between zero and six months in prison and face up to a $9,500 fine.

“The offense level and guideline range, however, do not account for a downward departure pursuant to Section 5K1.1 of the United States Sentencing Guidelines reflecting the defendants substantial assistance to the government, which the government has moved for contemporaneously,” Mueller’s prosecutors wrote in a filing on Monday.

The sentencing memo filed by Mueller’s team of prosecutors on Tuesday came roughly a year after Flynn agreed to plead guilty and cooperate, which represented a bombshell development in the special counsel’s Russia investigation that brought him closer to the Trump White House.

Critics of President Trump predicted Tuesday that the seemingly lenient sentencing memo from special counsel Robert Mueller regarding Michael Flynn is indicative of a long-game effort to get a bigger prize.

The court filing states Flynn "has assisted with several ongoing investigations, including its probe of coordination between the Trump campaign and the Russian government" and suggests no jail time.

Former Hillary Clinton senior adviser Philippe Reines predicted that it quashes the possibility that the former national security adviser will get a pardon from the president.

"Imagine what he gave up on the big guy for Mueller to let him off without prison time," Reines tweeted. "It’ll be worth it."

He added, "It also means Flynn knows he gave Mueller so much that when trump finds out exactly how much a pardon will be out of the question."

Right. Somehow, all this time, Flynn has managed to make ends meet and has even fielded offers from lobbying firms. He made a lot of money with his consulting firm and draws a three star retirement salary. All of the postponements for sentencing have been joint filings between special counsel and defense lawyers. Why? Because all involved parties knew Flynn would be fine.
