H-1B Visa Bill Introduced In US, Minimum Pay More Than Doubled

Washington: A legislation has been introduced in the US House of Representatives which among other things calls for more than doubling the minimum salary of H-1B visa holders to $130,000, making it difficult for firms to use the programme to replace American employees with foreign workers, including from India.


The High-Skilled Integrity and Fairness Act of 2017 introduced by California Congressman Zoe Lofgren prioritises market based allocation of visas to those companies willing to pay 200 per cent of a wage calculated by survey, eliminates the category of lowest pay, and raises the salary level at which H-1B dependent employer are exempt from non-displacement and recruitment attestation requirements to greater than $130,000.


This is more than double of the current H-1B minimum wage of $60,000 which was established in 1989 and since then has remained unchanged.


"My legislation refocuses the H-1B programme to its original intent - to seek out and find the best and brightest from around the world, and to supplement the US workforce with talented, highly-paid, and highly-skilled workers who help create jobs here in America, not replace them," said Lofgren.


"It offers a market-based solution that gives priority to those companies willing to pay the most. This ensures American employers have access to the talent they need, while removing incentives for companies to undercut American wages and outsource jobs," he said.


Lofgren said it removes the 'per country' cap for employment based immigrant visas so that all workers are treated more fairly and to move to a system where employers hire the most skilled workers without regard to national origin.


It raises the salary level at which H-1B dependent employer are exempt from attestation requirements to a new required wage level of 35 percentile points above the median national annual wage for Computer and Mathematical Occupations published by the Department of Labour Occupational Employment Statistics (roughly $132,000), which would be adjusted in the future without the need for new legislation, and eliminates the Master's Degree exemption for dependent employers.


The legislation sets aside 20 per cent of the annually allocated H-1B visas for small and start-up employers (50 or fewer employers) to ensure small businesses have an opportunity to compete for high-skilled workers, while still protecting against outsourcing.

H1B is not the only one. There is another work visa for lower pay workers, Trump uses it for his resorts where he can pay these foreigners $12-15 an hour to vacuum floors and make beds (technical skills that Americans lack)

I'm trying to find out where in the Constitution that it is the responsibility of the Government to protect jobs.  I thought Conservatives believed in the Free Market..

I'm trying to find out where in the Constitution that it is the responsibility of the Government to protect jobs.  I thought Conservatives believed in the Free Market..

No where in the Constitution does it say the federal government must import workers on demand of corporations.

If we went the strict Constitutional route here these workers would get in line with the rest of the immigration applicants.

So you want big Government?? I'm trying to find out where it stated that everyone has a right to a good paying job??  There will be ways to work around it. They could send more work offshore.. Unless you want more Government regulation to stop it.

So you want big Government?? I'm trying to find out where it stated that everyone has a right to a good paying job??  There will be ways to work around it. They could send more work offshore.. Unless you want more Government regulation to stop it.

The government guards borders and regulates immigration. Thats all the government I want.

Its the H1B users that are looking for a government hand out.

Unfortunately, foreign Registered Nurses fall in the H1-B category. Boosting the salary simply because of the IT industry will adversely effect the healthcare industry where there is an actual shortage of nurses.

If you believe in the invisible hand of the marketplace you'll have faith that higher salaries will mean more aspiring nurses entering the field.

The problem is when people who have lower salary requirements, 1st generation immigrants from third world countries  heavily dependent upon public assistance, compete with those Americans hoping to maintain a decent standard of living on their own.

The law is already on the books. Would I like to see it repealed entirely? Sure. But in the meantime, I'll settle for making it favor workers instead of corporations.

If nursing wasn't farmed out to the low wage H1Bs to begin with it would never have been an issue. Like every other 'need' for imported labor, it was created when unions priced American labor out of the market.

To fix the mess you have to bust the unions and reset the system/economy/labor laws from scratch. Yes it will hurt. But the alternative is status quo with no possible resolution.

It isn't in the constitution,  but the protectionist system was decided to be the defacto system under which the Union would do business,  and  that this system would be enforced was determined by Abraham Lincoln.

Nursing salaries are at an all time high. Those foreign trained nurses are being paid salaries equal to American trained nurses. Foreign trained nurses working in the USA are not receiving public assistance with salaries of $60K to $90K annually. They are not lowering salaries for American nurses. They are in fact providing a valuable service.

Unlike the IT industry, foreign trained nurses are being paid salaries equal to American trained nurses. Bringing in foreign trained nurses is not an inexpensive option for most healthcare facilities needing RN's.

If there's a shortage, doesn't that tend to drive up wages anyway (law of supply and demand)?
