Airbnb in Disputes With New York and San Francisco

Airbnb has charmed and strong-armed lawmakers around the world to allow it to operate in their communities. But two cities, Airbnb’s hometown, San Francisco, and New York, the service’s largest United States market, have not been so compliant.

On Monday, Airbnb sued San Francisco over a unanimous decision on June 7 by the city’s Board of Supervisors to fine the company $1,000 a day for every unregistered host on its service. If Airbnb does not comply, it could face misdemeanor charges.

The suit follows a bipartisan move by New York lawmakers who voted this month to heavily fine anyone who uses Airbnb to rent a whole apartment for fewer than 30 days, a practice that has been illegal in the state since 2010.

Of course, these cities/counties are going out of their way to favor the hotel industry who rake in millions of $$$ to their coffers and squeeze the little guys out.
2016 shows that most so-called conservatives & liberals want a tyrant, not a leader; Americans want a monarchy, not a republic.

Because the hotel industry pays a daily room tax, to the city or other municipality.

I knew a man that had a big house, subdivided into 3 sections, in a beach resort town--long before AirBnB.

He advertised on the internet, and was doing well, but the city discovered him. He simply decided to sell the property and move on to something else.

He was 40 something, had been semi-retired for over 10 years after making $millions from something before.  His plan, go back and start another big money maker, but not hassling with city bureaucrats.

Problem is the government bureaucrats (of all levels) act as though we serve them rather than the other way around.  :smash:

“I’m still shocked and saddened by the whole thing,” she said.

Four years ago, the Fullerton couple bought and renovated a pair of condos near Disneyland, renting the properties for about $200 a night. The income allowed Hochgesang, a 39-year-old mother of three, to leave her teaching job and stay home with the kids.

Late Wednesday, the couple became potential outlaws.

The city voted to end short-term rentals in Anaheim, giving owners 18 months to wind down their businesses. After that, the city will monitor neighborhoods and websites like Airbnb and HomeAway, looking for listings to fine.

Some Anaheim residents are thrilled with the new rules.

This is NOT something new. I do NOT rule out somebody fighting it up through the courts. Why is it to be "illegal" for them to rent for one week, but okay to rent for a month or for a yearly lease?

Before AirBnB, there was another site which was successful. VRBO, standing for "vacation rentals by owner."

They do more or less the same function, and there are others. They allow individual property owners to rent all or parts of properties, for short terms.

I have some knowledge, as a real estate broker in what is becoming more and more, a resort area (California coast).

I do not deal in the market, per se. There is nothing new about the market. People have owned resort properties, and have rented them all over the world.

A friend of many years had a beach house, in Ocean Beach Maryland for example. He essentially "turned it over" to a local specialty broker, who handled everything.

Neighbors MAY object to having short term people in their vicinity.

Most important is the local taxing jurisdiction which feels "entitled" to reap revenue from economic activities. Hence  daily "room taxes, permitting and inspection fees" etc.

To some extent, AirBnB is like Uber, in that they facilitate commerce directly between willing parties. The objection comes from other parties, which are losing business and taxes.

VRBO was in place as an internet website, long before AirBnB, which is a mobile App.

Mobile Apps are fast substituting and growing the market for their uses. In real estate something like 2/3 + of searches are from mobile apps, not big screen websites.

Anaheim isn't just cutting off short term rentals of entire condos/apartments/homes such as Airbnb, the same rule banned home sharing – in which a homeowner rents out a room of their home to a tenant.

So much for property rights. God forbid that a family wants to have rental properties that bring in enough income that the wife can raise her own children.

Of course it is, just like regulating Uber out of the picture protects the existing taxi lobby

Ironically for those who hate San Francisco, that is where a lot of this innovative business model origination is taking place.

Thinking outside the box. Possibilities. Breaking the mold. Entrepreneurship. Free enterprise. Individualism.

Uber has not won all their battles, but they have won most.

I expect AirBnB will go to court, to contest a city that tries to block individual property rights, too much.

But Anaheim is a powerful city. With Disney and the other big venues, they have a lot of hotel room taxes at stake.
