The Marketplace Fairness Act is proposed legislation pending in the United States Congress that would enable state governments to collect sales taxes and use taxes from remote retailers with no physical presence in their state. Identical versions were introduced into both the United States House of Representatives and the United States Senate during the 113th United States Congress. During the previous, 112th Congress, a bill (S. 1832) was considered but expired without enactment.

I have a general guideline. If any law has the word 'fair' in it- then it isn't fair to the citizen. If any law has the word 'neutral' in it, then it isn't neutral. If any law has the word 'better' in it, then it will make things worse.

In this case, because the States would be collecting from entities in other States, it would technically be constitutional to be a federal bill versus state (actual legitimate use of often abused the interstate commerce clause.) However, just because it has Constitutional jurisdiction, doesn't make it right.
