WASHINGTON – Supreme Court Justice Antonin Scalia’s body was not even cold before the Democratic National Committee was raising funds over his death Saturday.

The DNC sent out an email fundraiser decrying pledges by Senate Majority Leader Mitch McConnell and several Republican presidential candidates for saying the Senate will not entertain confirmation of a new Supreme Court justice until 2017 and enlisting support for the claim the Constitution requires confirmation.

“There’s no excuse for this,” the email reads. “It’s putting partisan politics above the Constitution and the rule of law, and it’s appalling to hear from any public official – let alone someone who thinks he should be the next President of the United States.”

The Democratic Party used advertisements like this one to raise funds in the immediate wake of Supreme Court Justice Antonin Scalia’s death.

When respondents sign up for the confirmation fight, they are prompted to contribute to the DNC.

Under the Constitution, nominees to the Supreme Court require confirmation by the Senate, but there is no requirement on the Senate to hold hearings, entertain the nomination or confirm.

Scalia, one of three conservative jurists on the court, was the longest serving justice on the court, appointed by President Reagan.
