Idaho is set to nullify federal gun laws
« on: March 21, 2014, 06:17:50 am »
Idaho is now poised as the next state to enact legislation that would effectively nullify federal gun laws within its state borders.

From Brenner Brief News:

Quote
Federal gun laws may soon not apply in Idaho, which could become the latest in a series of states acting to nullify federal gun laws within its borders. Both the Idaho House and Senate have unanimously passed the Idaho Federal Firearm, Magazine and Register Ban Enforcement Act, or S.B. 1332, which would effectively nullify future federal gun laws by prohibiting state enforcement of any federal act related to personal firearms, firearm accessories, or ammunition. Idaho’s legislation follows similar moves by Arizona, Florida, and Missouri.

The bill passed the House by a vote of 68-0 and the Senate by 34-0. It is now confirmed delivered to Idaho Governor Butch Otter for a signature. ...

The legislation also stipulates penalties on anyone attempting to enforce nullified laws within Idaho...

The Tenth Amendment Center asserts that the legislation rests on a well-established legal principle known as the anti-commandeering doctrine. That means the federal government cannot “commandeer” or coerce states into implementing or enforcing federal acts or regulations — constitutional or not. ...

The Tenth Amendment Center says the blueprint for the anti-commandeering doctrine comes from Founding Father James Madison in the Federalist 46 of the Federalist Papers.  [Bold added]

The law is a lot of bark and almost no bite.  Why?  Because the federal government has quite enough resources - isn't that what all the yammering about FEMA buying millions of rounds of ammunition was all about, the fed's resources? - to enforce federal law on its own and it really doesn't need state law enforcement.  So, instead of dealing with local law enforcement, who know the temperature and tenor of the local community, and are more likely to take into account someone's bona fides and use prosecutorial discretion to avoid meting out too harsh treatment, people running afoul of federal law will instead be "entertained" by federal law enforcement, like FBI and ATF, and they are gorillas, they don't care who you are, they don't care if you're really a nice guy who just made some innocent mistakes, they only care about whether they can make a proper example out of you, and when they decide to do so, they will crucify you.  Pilate and his soldiers had nothing on the federal law enforcement thugs.
