WASHINGTON — A top IRS official in the division that reviews nonprofit groups will invoke the 5th Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening — or why she didn’t disclose it to Congress, according to a letter from her defense lawyer, William W. Taylor III. Lerner was scheduled to appear before the House Oversight Committee on Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell Issa (R-Vista). The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

Nothing like visions of the taxman acting so badly it's criminal to scare the bejeezus out of Mr. and Mrs. America.

I'm sorry, but you're not talking to the cops here - who are corrupt and will twist what you say to convict you - you're talking to Congress, which although also corrupt, will just twist what you say to score political points but not to put you in jail, so there is no Earthly reason to take the Fifth in front of Congress unless you have, in fact, broken the law.

That isn't to say that she shouldn't take the Fifth - by all means, it's her Constitutional right so she should use it freely; however, as far as measuring what was going on inside the IRS, the fact she's going to take the Fifth tells us volumes.  That means we now have confirmation that the IRS attack on conservative tea-party related groups was managed at high levels and was not just the work of some off-the-rez low-level, front-line employees in Cincinnati.
